if a bailiff collecting a magistrate court fine has seized your goods (old regs) and the warrant of execution has expired is the notice of seizure still valid

P T thanks for the reply

I don't know the notice of seizure was done in December the warrant expired in January they have been late with a few payments but haven't paid this months payment that should have been paid beginning of the month as of now they haven't received anything from the enforcement company or the court

In fact, with a Distress Warrant is does NOT expire. Under the old regs, a warrant of execution (for an unpaid parking charge notice) had a 'life' of 12 months (although that has changed under the new regs).

 

What you may be referring to is that if a Distress Warrant had been with a bailiff company the Contract with HMCS stipulated that the warrant should be returned back to the court after 180 days (6 months) if uncollected. However, if a payment arrangement was in place this requirement would not apply. Also, the enforcement company are permitted an extension to the 180 day requirement.
