      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I had an egg loan sold to Apex credit.

 

I sent them CCA request 3 years ago and they replied with a CCA.

 

However I have never paid them and they have never chased me.

 

I am trying to sort out finances at the moment

 

but am wary of phoning them after all this time.

 

Does anyone know why they have not been in contact ?

you should NEVER phone a DCA - end of.

 

you indicated in a past thread that the egg loan & Credit card were merged

 

so this is not the case then?

 

is this on your credit file?

what is the defaulted date

 

when did you last pay anyone on it?

No, they never told us.

 

The most important thing here is whether the debt is statute barred. When was your last missed payment? When was the last time that you acknowledged the debt

I don't think I have got to the six years ago yet.

 

The last time I acknowledge this debt was 2011 at the latest.

 

At the time I had a letter from Apex saying they had brought the debt from Egg.

 

I sent request for CCA and they did send me one and now they have not ever chased for the money.

well if all of your old addresses are showing

 

it might be prudent to get a cra file from at least two sources

 

then if the debts don't show

 

then they are not harming you

and unless you are getting letters a bout them

 

i'd let sleeping dogs lie.

they did in the past have a default on my file but it is since now showing it dropped off .... i think your right with letting sleeping dogs lie but I worry they will come out of the wood work and do something like bankrupcy to me

I forgot to ask how old they were

 

yes the whole account will vanish

once the default date reaches its 6th birthday.

 

of course this does not mean the debts are not still 'owed'

 

so you have no real idea on your last payment date?

well you could send EGG via their Canadian square address an sar

 

that will get you all the statements etc etc

 

or you could just let it run

 

as said, it is not harming your credit rating

as it obv defaulted more than 6yrs ago.

 

but this if no guarantee they are not leaving things till toward the end of the SB period

to gain as much statint IF they did start proceedings.

 

IMHO I would get that sar done and gather as much evidence/info as you can.

 

that way atleast you will be prepared for the worst.

that is what I am worried about they are leaving until it comes up SB and then they will do the worst .... bankrupcy etc ....should I just phone them now and make token offers to try and keep them at bay ... what is the address for egg ?

no you do not ever phone a DCA

 

get that info

 

you need to gather stuff so's we can assess the issues that might be there

 

they'll also need a SIGNED agreement if it was taken out prior to about 2005

 

you've prob PPI I bet too

do I post to Canada Square Address in Worthing? I have written a sar letter.

 

Also will they tell Apex (who the debt is with) but I haven't heard from them for 3 years?

 

Has anyone else had egg loans go to Apex and then never hear anything ?
