A friend of mine was prescribed with an overdose of a drug by a Private consultant in a Harley Street clinic. It has led to complications as one might imagine.

 

Can anyone tell me if she would be able to get copies of ALL her medical notes and whatever they hold in the clinic by issuing a Subject Access Request or any other method as she's not getting straight answers from the clinic?

 

She may have been having the consultation via her medical Insurance (not sure)although I know they pay the fee, but she does have Insurance I do know. She was not referred by her GP though.

The clinic/consultant would have a duty to protect her data so must surely be subject to DP. I'm sure a sar is appropriate.

I have passed-on the link to the ICO website and the pages concerned as this will have to be a choice for her to make whether she ruffles feathers with her consultant and his breed of colleagues who were responsible for this, or not.

 

The medical profession are very much like the legal profession when it comes to protecting themselves and sticking up for their chums so unless she's prepared to battle then she'll hold off, but I've given her the tools with which to work thanks to you good people if she needs to and knowing her inquisitive and insatiable appetite for getting the truth, I reckon that it would be unlikely that she didn't do it.

 

Mind you, she'll probably get her husband to do his first with his Doctor to see what comes back before she sticks her own head above the parapet - that should be interesting poor fella:-)

No, she's made no formal complaint as yet. This is slightly tricky in so far as she does have continuing medical issues which do need specialist attention and she is a bit of a Mrs Bouquet when it comes to only seeing the 'best'..whereas I'm quite comfortable using the NHS and have had good, no excellent, treatment whenever I've needed it.

 

Some people think only Harley St can provide what they want, so she does see a number of them and doesn't want to screw her path as it were. The fact they overdosed her was a shock and has had knock-on effects, but I think she'll probably go and ask for her records first as a softer option, then if she finds anything untoward she'll decide what to do. She's also not someone who takes issue with complaints like we on here do, so I'm just pointing out what's available to her and leave it with her to stew on. If she knows the records are easy to get, then she's gonna want to know what's in them, she can't stand people talking about her so it'll come naturally I'm guessing to want to know what's gone on in 'a file' about her.
