Replacement Product

I have a pair of "Studio" Beats by dre headphones.

 

These have became faulty and are in need of a repair.

 

However beats are objecting the repair due to these headphone being outwith the warranty.

 

The headphones i had were replaced in july 2013 and i received a new pair.

 

Would this be contestable as this is a new product

- do the new headphones come with an extended warranty ?

- The original warranty ran out in december 2013.

How did you pay for them? Where did you buy them?

Any warranty is in addition to your statutory rights but to address your question as to when the clock starts on a warranty, it is the day you bought or accepted the goods. Now, supposing your warranty allows for a replacemnt product the receipt of a new pair of earphones does not restart the clock so if the new ones conk out and it is outside the original warranty period that is hard luck. Where the SOGA comes in is that it sets no timescale for the liability of the seller of the goods but says that they must be of merchantable quality and fit for purpose. This is then determined by various sources as to how long things should last and that will depend on they type and function of the goods as well as the price paid. Usually for electrical goods that means 3-5 years. If the fault is known as a manufacturing fault then Beats are liable as it is a latent fault (bit like a car recall, they are supposed to put it right via retailer and then compensate them) but other than that it is for the retailer to make good and get their money back from Beats, not for you to chase Beats.

Beats actually retail the product, so he might be chasing the retailer.
