      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello to everyone and I wonder if you can give me some advice please.

 

We took out a loan with Blemain finance in 2007 for £20,000 to finish our house renovation.

 

We have been paying it for the last 7 years and when

 

I received a statement form them it says we owe £27,000.

 

I have worked it out that we have paid over £20,000 to them already

so i am puzzled as to how we can still owe this much.

 

Any help mill be greatly appreciated.

join the club mate I took a loan out for £105k paid back over £160k and still owe over £100k I been to all the relevant authorities and even had some solicitors on the case but been 8 years still no luck!

depends how the agreement is written.

 

and how the interest is charged.

Hi John,

blemain are experts in adding costs to accounts,

 

your statement which you say you have may not actually show your charges which have been applied to the account,

only the payments you have made and where payments were due and missed if any and

 

then a running outstanding balance figure which includes any charges you have incurred.

 

im sure on that statement it will tell you what i have just said and then it will go on by saying if you wish to know of any charges

and interest that may be accruing on your account then you should contact us.

 

Call them and ask for the "list of costs and charges" which they will send to you separately.

 

It would be advisable for you to send them a SAR and a CCA request in the meantime as it will save time later.

I will do this 1st thing Monday morning.

I have been reading horror stories about this company and I think I will have a battle on my hands to have them treat me fairly.

Apparently the capital in coming down by approx £20 a month but the interest on fees is going up by £43 a month :(

I'll let you know how I get on and would be grateful of advice as to the next stage.

Depending on the fees you could reclaim them. Especially any insurances.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

They con people out of money by first adding charges i.e insurance late payment fees letters and anything they can make up, then you are charged interest on top ask for a full and thorough break down of all fees, charges, interest. you may even find that the payments they told you to pay were never enough to pay off the loan. This company is as bad as it gets (1.25 million fine in Dec 2012 by FSA for poor treatment to its customers and yet they boast awards for being such a good company (good for dodgy, could'nt care less about there clients, brokers)

At a guess £1300 relates to one of the many charges and possibly the most obvious one that a professional would pick up. have you seen a full break down of your costs and charges. one thing for sure it will certainly be an under payment

my mam took a loan out of £4,00 and then upped it to £12,00 and

 

 

my dad did not know about this until my mam died he was not happy,

 

 

altogether with what they paid back over 20 yrs at £400 a month was astonishing.

 

 

When we contacted Blemain finance and asked them to send copies of the loan agreement

they said they would but never did.

 

 

We phoned on several occasions and asked if their was ppi on it they said no.

 

 

What a horrible company.

 

 

I will let yous work out how much they paid back as I feel sick when I think about it.

 

 

I feel sick to my stomach for all of you people who are still struggling.

If it's a secured loan either:

 

a) The property is in your mother's name only

b) Your mother forged your father's signature

c) The lender hasn't followed the law and there could be scope for a challenge to the validity of the agreement.

My dad has since died but my mam had never told him of the loan, she was good at signing forms in his name as he had parkinsons and shook a lot with this. The loan has now been paid of for about 6 yrs so dont, think we could do anything about it.

statements are the main thing and the mortgage agreement

 

redact them and post them up

**you can post up images/letters by this method immediately..you don't need 10 posts**

.

set your default scan page size to A4 less than 300DPI [150 will do]

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

ENSURE: remove all pers info inc. barcodes etc

but leave all monetary figures and dates.
