On more than one occasion I have been lied to, deceived, misled and threatened by advisers at Jobcentre. If only I could prove it!!!!!

 

My questions are these;

 

1. Is it within the law for me to record interviews with advisers at Jobcentre on a pocket recording device without notifying the adviser?

 

2. Would evidence of any of the above misdemeanours, or maladministration of any kind, gathered by using such a device in such a way be admissible at a hearing or tribunal?

1) Yes, it is legal but don't do anything daft with the recording like posting it on Youtube. Keep it for your own reference only.

 

2) That would be up to the judge or whoever is presiding over the hearing.

If your exposing serious breaches i.e. threatened, mislead, any sort of hearing/tribunal would definitely take that into consideration.

 

You could also transcribe the conversation and use that, that would be admissible.

Just do it - you don't need to tell them as it's your right under section 36 of the DP Act (plus you want to catch them in the act, don't you).

 

Not 'allowing' people to record is just JC policy and has no substance - they're breaking Data Protection laws every second by having open-plan offices where you can hear everyone else's personal business. 'Privacy' is a joke.

 

I record every dealing with the JC and so should we all.

Be advised that they can ask you to stop recording. If you persist, you could then be asked to leave the building. The danger here is that if business is not concluded, you could collect a sanction on the way out.

 

e.g.: You get caught recording on a normal signing on day. They instruct you to leave before signing the card. You get sanctioned for missing your signing on appointment.

 

Be discrete and/or carry multiple devices :wink:

For quite some time now I have been recording secretly for my own protection, A nice Dictaphone off EBay for £10 and my mobile phone voice recorder.

Due to all the new cuts and crap that the advisers come out with I have deemed it necessary to protect myself against anything they say, After all they

can't argue over their own voice on tape/digital recording when proved to be in the wrong.

 

Every single person who attends JCP should now use recording equipment of their own to protect themselves against the targets the advisers have to meet.

When it comes to a DM he will always take the side of the adviser unless you can prove otherwise, with a recording of the conversation its win win to you.

 

JCP appointment even signing on days, record everything, file the recording on the laptop or PC with date and time stamp for safe keeping.

 

Plain and simple don't trust them at all, they are now there only to fulfill targets and sanction you if they can find a way to do so.
