Hi,

I bought a surround sound/DVD in December 2013 and

at the of January it broken as no sound worked through the digital output.

We took it back and they sent it for a repair which took two weeks.

I was fine with this.

The same has now happened again so I need to take it back.

Clearly this is the second time in just over six months.

Can I therefore insist on a refund or a replacement to the equivalent model?

I don't want it repaired again as I can only assume it will happen again in a couple of months.

Thanks

Thanks for your reply.

What would happen if it kept breaking and then surely the item clearly wouldn't be considered fit for purpose

or would it just keep getting repaired until the guarantee run out?

Hi scedminc

Under SOGA, send them the following template in the link, amend it as necessary. Add that it's already been repaired once and that a further repair is unacceptable to you, as you've spent £500 on the product and it less then 6 months old. Explain that you want it replaced or refunded. Send the Template Recorded Delivery

If they come back with, they can only offer you a repair, contact your Card Provider (Credit Card), ask to do a Section 75 claim. Send the template in the link below, again explain that it's been repaired once, it's faulty again. Send it Recorded.

section 75 can certainly be used to your advantage here as well.

limitless 'repairs' are not an option

neither does any warranty play any part here - and never does

that's in addition to your statutory rights under SOGA.

I would expect if the new failure is related to what was repaired before

it would be a natural replacement.

ofcourse you can bring pressure to bear in indicating you

would not be happy to accept the same unit repaired & returned again.

if you'll get anywhere is another matter.

I would expect the credit card company will get the same reply to any

request for information they make too

lets see
