I really hope someone can help me here as Sigma Red and HL solicitors are driving me insane.

I had a debt owed to virgin media and was referred to these two companies,

fair enough I owe the money so

on the 19th of March I setup a payment plan with payments place,

initial payment sent of £15 with payments scheduled to go out on the 18th of each month.

I had an email on the 14th of May informing me that Aprils payment was a few days late (it went out on the 23rd)

the plan had defaulted and they would collect on the 18th of this month.

On the 19th of this month I had an email stating that my bank did not allow them to take payment and they will try again over the next two days.

On the 20th I receive an email saying thanks for the payment etc.

Then I received a letter on the 23rd dated the 19th from HL solicitors saying that I haven't stuck to the payment plan

and if I don't pay in full in 14 days that they will take me to court!!

Just what the hell is going on here?

I setup the payment plan with them,

there was enough money in my account to pay on each month,

it's not via a standing order or direct debit but POS so it's them that takes the money out,

I have no control over that.

Argh, what do I do, should I call them?

Eeeeek... Ignore them... It's a pressure tactic...

How much is the debt for?

If you owe it, pay it to VM directly, cut out the middle men

If you have given them your card details they will clean you!! Cancel the CPA and the card with your bank! NOW!

Pay by standing order only! That way you remain in control

We could do with some help from you.

when is this supposed debt from?

i'd be contacting VM only.

never pay a DCA or their fake/tame solicitors

they are NOT BAILIFFS

and have

NO SUCH LEGAL POWERS..

stay off that phone to them too!

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

The debt is around 6 months old and is on my credit file.

I'm happy to pay what I owe (around £300) but can only currently afford to pay it off monthly which Is what I'm doing.

I'm just worried that if I don't contact them that they will issue a ccj against me.

It's strange that no other payment to or from my account has ever experienced 'issues' before.

cut out the middleman

I've never known a VM debt goto court

I tried to contact VM but they said it was too late etc.

As for owing the money, I had a long term relationship fail and I lost everything and had to move out within 2 weeks and pay off a load of bills.... which were mainly in my name.

The debt was basically for cancelling the contract early as I couldn't take it with me.

so you did cancel?

then you should only be charged the cancellation fee

not £300

I would NOT be paying a dca

cancel whatever you have got in place.

what is a POS?

have they got your bank details or card details [the dca]

you need to write a complaint email to the CEO

Then has DX says, you pay the cancellation fee only, you do not pay for the remaining service in your contract because you could not transfer the service, this is Virgin Media's problem, not yours.

Therefore, ask for a full breakdown of the amount, pay to Virgin Media any Call Fees/Broadband/TV that has been used prior to you moving out of the property, plus the cancellation fee minus any payments made to the DCA.

You said you paid via POS, if this is a Point of Sale transaction, was this online, over the telephone by automation or manually by speaking to a telephone monkey?

  • Confused 1

NEVER telephone a DCA

If a DCA rings you, refuse to go through the security questions & hang up!
