My FLorida holiday home went into foreclosure in 2010.

I had tried to negotiate a "short sale" with the lender but they would not agree to this.

 

 

I have today received a very threatening letter from a uk debt collecting company threatening me with taking action through the US courts that will give them the right to take me to UK courts and seize my UK assets in order to settle the outstanding amount of the debt.

 

 

Does anybody know if the UK debt company has the power to do this ?

 

 

Does anybody know of a UK solicitor that is expert in this field that can act on my behalf if I need to try and negotiate with this company

I think they are trying to worry you into making a payment arrangement with them, for which they will pocket a large chunk in collection fees. They will then cash cow you for years, for a debt that they might not bother to try to enforce in the UK.

 

If the current debt owner in the US is aware that you live in the UK and have your UK address. I believe that if they instigated court action in the US, they would have to serve you with court papers in the UK. You would then have a chance to defend action in US courts.
