      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,helping a family friend out,basically he has a loan from black horse and has got serious debt issues.

 

I helped him fill a income form in with his incoming and outgoings and typed up a letter asking for reduced rate.

 

Now im sure ive read on this forum before that you never sign the letter with your signature so he printed it in capital letters,however they have wrote back acknowledging the letter and form BUT cannot help any further until they get his signature on the form?

 

Any help/advice please thank you

If he is asking for assistance from the OC, then yes a signature 'could' be sent on the form.

 

HOWEVER! Have they been communicating with him at the address?

Has he recently moved?

Did he inform the bank he had moved and have they been corresponding with him at his new address?

 

It's no real great shakes signing a letter when you asking the OC for assistance, the only time you want to be difficult is in response to them dragging their heels and being awkward.

 

He can just sign it slightly differently to his usual sig, then if he suspects any funny business has gone on (which will be highly unlikely) then he can raise it at a later date.

 

The whole idea of not signing documents is normally when the DCA's are demanding sigs, or if there is some question as to the validity of the agreement in question?

 

How old is the Loan? Pre or post 2007?

Having spoke to him the loan is pre 2007, He has until now just informed them of moving house as old house is rented to family member of his so he still received mail there for the loan,however has not had no correspondence from them until now as payment was taken through direct debit which he stopped to avoid more charges.

 

So all in all it's safe for him to send signature and see what they come up with?

Pre 2007 I wouldn't send them anything with his signature on, just yet..

 

Exactly what year was it taken out?

 

Is his bank local? Is he able to take another request into them and hand it in personally?

OK, so atm all he is asking is for them to help out as he is in a financial quandary, then IMO it can only help his situation

by signing the letter, but ensure he scans a copy of the letter he sends them for future reference.

 

It is highly unlikely they will lift & copy his signature onto anything, however he isn't asking them for the CCA just yet, if he were then I would be very sceptical

of sending a signed CCA request to them.

 

Again IMO return the signed request, after all he is hoping they will be able to assist him so it is prudent to bow down to their demands at first.

 

When you say you have asked for a reduced rate, is that a reduced rate of payment each month?

Will this be for a specified period (6 months) or for the life of the loan?

 

Is there any PPI or charges added to this which he can reclaim?

Thanks for all your help BB yes you are correct letter was to reduce the payments to £10 month for 12 months then re-calculate see if any more can be payed.He say's there is no PPI on it and ill make sure we scan the letter with his signature thank you once again

OK did you use the letter template off here or just your own?

 

Did you ask them to reduce or stop the interest also?

They will normally do it in 6 month blocks, so 12 months might be pushing it, IMO I would ask for six months, and then you will re-evaluate after that agreement has expired

and make another offer to them either increasing it or reducing it etc..

 

Your doing everything right, just keep a diary of events and copies of everything you send, and mark the dates you receive their correspondence. Keeps it all in order.. :thumb:

why is a loan from 6yrs+ ago still running

Just after a little more advice on this situation, they have sent a letter back saying thank you for the offer of £1 month in order to accept this offer and make regular payments you first need to pay a £85 set up cost.

 

What do i write back to this company is this right?

Regarding the sar,he still has not had any benefit through so has no money for it,and won't really have £10 spare when it does come through!

 

I have told him to write back and say that there is no way he can afford the £85 set up and again offer the £1 month does that seem fair to say ?

This set up fee is nonsense not in all the time I have been here have I heard such a fee asked for.

 

 

Personally I would be making s Formal Complaint to BH at director level, asking for a fee when BH is aware of your friends financial situation is unfair/unreasonable, £85 is well over the top and seems like a "penalty".

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

can you scan up the letter?

 

**you can post up images/letters by this method immediately..you don't need 10 posts**

set your default scan page size to A4 less than 300DPI [150 will do]

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

ENSURE: remove all pers info inc. barcodes etc

but leave all monetary figures and dates.
