      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I know there is a section in the PDL forum but...

 

Do MMF ONLY collect/purchase PDL's or do they cover other forms of debt , I would be interested to know if anyone has knowledge of that.

 

On a separate note I awoke to an email from my friends asking me to contact them regarding my outstanding account. Needless to say it will be added to my todo list somewhere below recommending noddy for a knighthood.

 

So far only 1 email and not a single phone call , I feel so unloved. I will wait for a letter

A friend of mine was contacted a good year plus ago now about an old Barclaycard debt which was well and truly Statute Barred.

 

By the looks of the threads posted, MMF now mostly deal in payday loans but also they buy old distressed debt that are very cheap to buy, but when you play on a debtors lack of knowledge this then becomes a very lucrative investment.

They collect varying kind of obsolete debts. They dont care what the debt is, theyll just use every way they can to pressure you into paying up.

Report them to the fca and get a formal complaint in. Also read up on harrison v link

Hi

Just need to check the current contacts at MMF.

Obviously there is Barny and Neil but is Bazzer still there and anyone else?

 

Since the FCA rules came in can anyone clarify the state of home visits. If I read the FCA rulebook it seems to say that a visit can be made with due notice even without consent but does the statement in the library letters still apply.

 

Finally just to clarify, when a company receive a prove it/ prove right to collect etc they MUST stop all collection activity until they have done so?

 

Finally the CSA code of conduct clearly states that details of the debt must not be disclosed by email unless the debtor has agreed to it

Not surprised. Look at how the company performed after he joined. Look at his previous company too when he was employed there, compared to how it is now. He's prob jumping ship before it sinks.

Their incompetence knows no bounds. Another email about midnight last night.

 

Does anyone agree that this is an unreasonable time to be sending emails as many people have emails pushed to their phones and tablets

 

I know they received my letter last tuesday , it it again unreasonable of me to have expected them to have taken note of this by now .

 

Maybe I should rephrase that, would it be reasonable to expect any competent firm to have acted on this by now?

From experience over many MMF problems letters are routinely ignored not even acknowledged.

 

MMF is conditioned to believe that what it says is always correct, and cannot deal with criticism or challenges.

 

I have a number of letters on file which can only be considered amateurish, no punctuation and spelling mistakes.

 

I have retained envelopes hand written that appear to have been written by a very young child.

 

To answer your question "competent" they are NOT!

I am thinking that when, and no doubt it will reach the Fos stage, the standard to be achieved would be reasonable actions by a competent firm hence my question of would that timescale be classed as reasonable?

In the highly unlikely event that I were to take up corresponding with DCAs / debt buyers, I would certainly ensure not to use an email address that gets pushed to a mobile device, certainly not one that's left on at night. I would use a disposable address. Added benefit being that one can delete the whole address if it gets passed round.

Is there a pressing need to contact this "Bazza" in particular or has it just become a mission for its own sake?

MMFs "admin" falls far short of even basic competence, it show in every letter, e-mal, text and phone call.

 

 

Their protestation that " they are in a different position from " the man in the street" as they are a creditor so an alleged debtors requirements as to how they wish to be contacted does not apply to them" is one of the worst business practices I've seen, along with the "home visitor" calling to assess your property and belongings" the words 'utter' and crap' spring immediately to mind.

7 workings days is a reasonable time to respond believe.

Sorry if I am talking in riddles

Bazza = Barry Ellershaw who was customer relations manager which in itself is a laugh as he couldn't manage his way out of a paper bag. As for the email address, the one I sent the email on is the one they first contacted me on. Now I suspect that they do not have my address and I haven't given it to them although if they look in the files they will have it from a previous encounter. That is assuming anyone there can actually read. My letters are all addressed to the owners of the company , Barnaby Page and Neil Petty but I am also trying a scatter gun approach .

There phone number and txt address are blocked now on my phone but it keeps a record of every attempt

 

As for having it pushed to my phone, well I could set filters up or times for it not to happen but this is not really the point is it. I should not need to intervene in my normal day to day activities to avoid harassment.

 

I have or had more email addresses than I care to remember so really don't want anymore

I am in total agreement with you about the drivel they come out with especially on doorstep visits although I have been reading the FCA rulebook and as far as I can see there is nowhere where it states that we can remove rights of access, if someone can come up with the appropriate quote I can add it to my letter. Of course I have included the normal rights of access .

 

I will be forwarding the letters to daniel at the CSA as well as there is no reason I can not get them on the case before the Fos

 

You may have gathered this company really XXXX me off

 

P.S. Did you know they have also been chasing a great "friend" of mine who lives in Toyland

I thought the FCA Rule book made Reference to the OFT document on contact??

Hi Brig

Been reading it again and although there doesn't appear to be anything specific there is plenty about reasonable requests etc. In the email that arrived last night they threatened an unannounced visit which does directly contravene 7.9.12

Just checked quick phone call it is still possible to insist that contact is made as preferred by the debtor (alleged of course).

Well Bugger me , just had another phone call and text

 

So as of yesterday they have had two letters , both received by the two owners and also the ascent email address and yet they still bloody call.

 

I am suspecting that at this point they can't work out where I live ( I wouldn't have thought that was difficult even for thick people in Yorkshire)
