WRAG Mandutory Reconsideration and x information.

I am in the process of appealing my WRAG placement (which was done without a medical) this is my 3rd year in WRAG.

 

I asked my GP this morning if he could and would write a letter for me.

I was told he felt there really was no need, and that they could contact him themselves if they felt the need (as if they will).

He maintains I am not fit to work but the surgery does not have the time to write letters .

I have asked my CPN for a letter (waiting on her getting back to me) if she says no, then I am scuppered.

 

I accept this might effect the mandatory reconsideration and they will say no, they are leaving me in WRAG, in which case I shall have to go to tribunal (if allowed) am I?

 

I am just worried that without written evidence they only have my word, my medication list and ME to base their decision on.

I won my first appeal but they placed me in WRAG, I am now appealing that decision and waiting for the UT dates.

The whole thing is an absolute disgrace and a farce, appeal it, send them a SAR as well, make them wish they hadn't rattled your cage.

It scares me to hell, it took me all weekend to pluck the courage to ask the Doc and CPN for help/letter it made me feel as if I was begging for help to claim something I should not be!

 

I think my MP is a fan of this scheme will check again, but I seem to recall seeing their name against the supporters list.

I am waiting to get the medical report back that left me in WRAG, (how can they make assessments when they do not even examine you).

 

What will a SAR tell me (excuse my ignorance).

A subject access request from the DWP will show you exactly what info they have on you, all the way back to when you first started claiming or on their books.

 

It's free from the DWP. no fee is charged.

I'm not a big fan of accepting help either, but there are times when you have to admit that outside assistance is needed,

there are plenty of people who can help you in this.

My 30 days appeal time are up tomorrow as from the date on the letter sent to me telling me I have been left in WRAG.

 

1 The letter did not get to me until 7 days after the headed date.

2 I wrote to put in my appeal ASAP which they say they did not receive.

3 I rang on Friday to ask what was happening (this is how I found out they had not received my mandatory reconsideration letter (also asking for my ATOS medical report).

4 So I had to make the request for the reconsideration over the phone on Friday (losing me over 10 days)

But this means my time has slipped away to submit any new evidence (which I cannot produce over night).

So if they reject my MR for lack of new evidence can I take my letters etc to the tribunal.

 

What is my next best step.

Submit the evidence as soon as you have it to the DWP. If it arrives after the decision for the mandatory recon then yes, you can send any evidence to Tribunal.
