Your thoughts would be appreciated.   [email protected] [email protected]   Re: MET Parking PNC at your Starbucks Southgate site   Dear Ms Rayner, / Dear Heather Christie,   I have received a Notice to Keeper regarding a Parking Charge Notice of £100 for the driver parking in the Southgate Park Car Park, otherwise infamously known as the Stanstead Starbucks/McDonalds car park(s).   Issued by: MET Parking Services Ltd Parking Charge Notice Number: XXXXXXXXX Vehicle Registration Number: XXXX XXX Date of Contravention: XX.XX.XXXX Time: XX:XX - XX:XX   After a little research it apears that the driver is not alone in being caught in what is commonly described as a scam, and has featured in the national press and on the mainstream television.   It is a shame that the reputation of Starbucks is being tarnished by this, with your customers leaving the lowest possible reviews on Trustpilot and Trip Advisor at this location, and to be associated with what on the face of it appears to be a doubious and predatory car park management company.   In this instance, during the early hours of the morning the driver required a coffee and parked up outside Starbucks with the intention of purchasing one from yourselves. Unfortunately, you were closed so the driver walked to McDonalds next door and ordered a coffee, and for this I have received the Notice to Keeper.   It is claimed that the car park is two separate car parks (Starbucks/McDonalds). However, there is no barrier or road markings to identity a boundary, and the signage in the car park(s) and outside your property is ambiguous, as such the terms would most likely be deemed unfair and unenforcable under the Consumer Rights Act 2015.   I understand that Starbucks-Euro Garages neither operate or benefit from the charges imposed by MET Parking. However, MET Parking is your client.   Additionally, I understand that the charge amount of £100 had previously been upheld in court due to a ‘legitimate interest in making sure that a car park was run as efficiently as possible to benefit other drivers as well as the local stores, keeping cars from overstaying’.   However, this is not applicable when the shop or store is closed (as was the case here), as there is no legitimate interest. Therefore, the amount demanded is a penalty and is punitive, again contravening the Consumer Rights Act 2015.   As the driver’s intention of the visit was genuine, I would be grateful if you could please instruct your client to cancel this Notice to Keeper/Parking Charge Notice.   Kind regards
    • I received the promised call back from the Saga man today who informed me that the undertakers have decreed it IS a modification and they will need to recalculate a quote individually for me. However it all sounds very arbitrary. The more I think about it, and with help from forum replies, the more I am sure that it is not a modification. If for example the original seatback had become damaged by a spillage or a tear, I would be entitled to replace it with the nearest available part. The problem is when it comes to a payout after an accident, there is no telling what an individual insurer will decide when he notices the change. I am still undecided which of the two best routes to go with, either don't mention the replacement at all, or fill in the quote form without mentioning, and when it comes to buying the insurance over the phone, mention it at the time.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

7 days ago i was looking to see if i could get a short term loan. I was using a website that said i had been accepted for a loan and to enter my bank details. Once i had entered my bank details i was told i would be charged something like £68.99 for the service that will be taken from my account at some point in the next 60 days (!?). I was then given my loan options and i clicked on one was asked to enter my details and was told again i would be charged £68.99 or there about for the service!!!!

 

I decided straight away at this point to not get a loan. Ever since i have been inundated with text messages and emails offering me loans. I receive over 40 texts a day at all hours of the day and night.

 

Is there any way i can stop the 2 payments for £68.99 leaving my bank account?

 

I realise i have been stupid and should have been paying more attention, but also feel these websites were designed intentionally to mislead people in to paying for a service nobody would ever want!!!

You might also want to write to the Loan finder company and demand that they cease pestering you with texts. Confirm that you do not want a loan and that their constant texting is now bordering on harrassment - if they do not stop and remove your details from their data base, that you will be making a complaint to the Financial Conduct Authority and the Ministry of Justice.

Thanks for replying, iv spoken to my bank (LLOYDS) and they have told me they can not do anything about it and to contact CAB to help me get the money back after it has left my account!?

 

Is it possible if i contact the loan companies i will be able to cancel the payments as it is within 14 days and i never wanted the service?

Get lloyds to state that in writing. I bet they wont.

Again thanks for the replies. Does this mean i have to wait for the money to go from my account and then apply for a charge back? Would it be worth speaking to the loan company now as the money has not gone out yet and its only been 7 days to ask them not to take the money out as i do not want the service and believe i have been misled?

No. They can block it from ever happening. basically if the merchant tries to take money, the bank will simply state declined.

Just be aware that most banks ignore the regulation thats in place, as a lot of people do not know their rights and issue baseless threats and never follow them up.

You have a couple of options to get your money back once it has been taken.

 

You can request a charge back as these fees were unauthorised,

or you can approach the brokers and ask for a refund.

 

The refund will be all that was taken minus £5.

If you have any trouble getting the refund, or if there is no easy way to contact them on their websites,

talk to the Financial Ombudsman.

 

They have dealt with a lot of this recently from several brokers,

and can guide you through what to do next.

You can also make a complaint to them.

 

These sites aren't necessarily designed to mislead people,

but they aren't always clear as to what will happen once you have entered your details.

You need to make sure you always read the T&Cs carefully,

and not provide your bank details unless you're 100% you're happy.

 

As for the unsolicited texts and emails, there isn't really much you can do other than unsubscribe from them.

They will stop eventually on their own, but since your details have already been passed on it is difficult to stop...

I had the same thing. The address this "company" was registered to turned out to be a chip shop on the coast some where.

 

I told the bank but they said I must have agreed to pay it. On my Payday, the payment came out of my account, and I couldn't get it back. Had to cancel my card instead.

these guys SGE Loans, Loans Direct, Loans Direct UK, etc etc are all taking money that they have not earned and do not deserve...

 

 

once you apply for a loan with one company they will bombard you with texts,e-mails and phone calls all day long.

 

 

. I applied for a few payday loans recently and did not get any money,

however THEY CHARGED ME for use of their services and

 

 

since then i have received countless offers from a myriad of companies and

I am so sick of it all I have changed my e-mail,

am going to change my mobile number and

I will also be switching banks to ensure they do not have any of my details...

 

 

I was foolish to give them my details in the first place and

now I am just trying to get back to square one, again I must say they are all take money from vulnerable people

who are just trying to get a loan, instead they get robbed!

 

 

I hate them all and I wish I had never gone there but

 

 

I have learned a lesson and from now on will not be taking any loans from anyone!!!

 

 

Just wish I had realised all of this before it makes me angry that these companies are allowed to operate in this way and just get away with it.

 

 

...they should all be locked up for fraud!!!!

 

 

makes my blood boil to think MY HARD EARNED MONEY IS NOW IN THEIR HANDS

and there is little I can do to get it back cos Im just the underdog and they are the big boys..

 

 

.what goes around comes around and I hope it comes FAST AND HARD!!!

 

 

Hard to write all this without swearing but I have a punchbag that is now cowering in the corner thanks to these bleeeps! ..

Theres plenty you can do thomass. You just have to be prepared to be hard headed and see it through to the end.

Dont be too threatening with them. keep your cards close to you and follow the rules. Let them or the banks slip up THEN nail them.
