I'm sure some of you good caggers will know the answer and hope you can tell me.

 

We all know DVLA provide names and addresses to parking companies so they can send out PCNs. What gives them authority to do this?

 

Having just been on data protection training, I was informed that personal data could only provided to others in case of crime or taxation purposes. Obviously this was in relation to my work so there may be other exemptions not mentioned in the training which is why I thought I'd ask you good folk.

Caro, someone called Stuart Walton asked the same question as a FOI in the link above.

 

Dear Driver and Vehicle Licensing Agency,

 

With reference to the fact that The DVLA is selling personal driver

details on to third parties, I would like to know the following:

 

1. Under what authority is the DVLA allowed to pass on or sell

personal details to third parties, without first seeking permission

from the people whose data it wishes to sell?

 

2. Why does this practice not contravene the data protection act?

 

3. The private parking business is unregulated and riddled with

poor practice and inappropriate enforcement, the business does not

exist to regulate parking, it is merely a means to issue 'fines' to

motorists. The fact that the DVLA facilitates this practice makes

it complicit in this disgraceful and dishonest behaviour. So what

is the justification for the DVLA in allowing these companies

access to personal data?

 

4. It is well known (and proven) that in some cases, the

information is being accessed by disreputable companies or those

with criminal connections, so why are there no safeguards in place

to ensure this does not happen?

 

5. I have never given my permission to the DVLA to allow my

personal details to be passed on or sold to third parties and I

strongly object to this practice. How do I stop the DVLA from

passing on my personal details?

I notice there's no mention of the ICO. Is there any info on their view on this issue?

THe DVLA reckon they sell our details on at £2.50 a pop - accordign to them this is the cost of providing the information. However, according to the article by Michael Browne - the tax payer is subsidising these requests. to the tune of £600K a year. Perhaps the DVLA should charge the correct price to the Parking companies !

The subsidy arises because the private firms pay £2.50 for documentation, which costs the DVLA £2.84 to handle.

 

This year the agency has received 1.8million applications from private companies, costing the public purse around £612,000.

Examples of reasonable causes for obtaining the information:

 

To trace the keeper of an abandoned vehicle or vehicle involved in a minor accident (for example, if a car has been driven into and damaged another vehicle, then been driven away).

To trace the keeper of a vehicle which has been driven away from a petrol station without paying for fuel, or which has been driven without payment of a toll bridge or tunnel.

To trace the keepers of vehicles that have been parked on private land without paying the parking charges.

To investigate suspected insurance fraud.

 

 

I see it mentions tracing keepers of vehicles parked on private land without paying charges but no mention of free private car parks, such as supermarket car parks who use ppc's.
