    • Hi, I need advice please, Back in November 2018 we parked at The Southgate McDonald’s/Starbucks car park at Stansted before getting our flight.I parked at Starbucks to walk to McDonald’s. I have received letters over the years and have never acknowledged any of them . I now have a CCJ against me as I didn’t think that it was real so never answered My latest letter from dcbl is a notice of debt recovery unpaid county court judgment of £347.92.I know I should have completed the CCJ.Is there anything that I can do now or should I just pay it.Thank you bingoboy

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

I have been getting harassed nonstop by MMF - regarding a debt which I settled via MacKenzie Hall for a Wageday Advance debt.

 

The debt was paid off 2 years ago - incurred due to moving house and new bank card / account etc - and eventually the debt for a payday loan was cleared with MacKenzie Hall. I have a screenshot and emails to substantiate this.

 

MMF are now chasing me for additional charges on top of this it seems...........of over £120!

 

I have asked them to substantiate the debt and all they have done is provide some numbers - which does refer to the sum that I paid, but these are just typed into the letter, and that there are costs outstanding.

 

There is no copy of the original credit agreement, no copy of anything with reference to the additional costs incurred, which have never been advised to me.

 

Can anyone advise what I should do next? Is there an email address that I can contact at MMF - as their generic one never responds to me, and I have emailed Wageday Advance to confirm payment of this and they are also now ignoring me!!!

 

Strange how they respond to emails when you are after money or repaying them back!!!

Write to MMF denying liability (recorded delivery) and ask them to fully support their claim in detail. If they continue to write to you without providing proof you can then complain to them on the basis that they have failed to substantiate their claim. This in itself will get you nowhere as they will not respond, however you can then complain to Financial Conduct authority.

 

Try to avoid using big words when dealing with MMF as it will just confuse them.

Specifally write to rob sands - compliance officer and invoke the formal complaint. Mark it private and confidential. Do Not send the complaint anywhere else within mmf.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..
