I would highly recommend sending the letter recorded delivery. Those who chose not to generally find that the bank didn't receive their letter.

I need reassurance that this is normal.

 

Sent the letter to them today saying that as per their letter offering me a settlement, I would accept as a partial settlement but would give them until the 18 October to refund all charges, before I go to Moneyclaim.

 

Also sent them my LBA on Tuesday which they would have received on Wednesday and just come home to a letter from them in response to my LBA saying

 

"As a gesture of goodwill we offered you £1,397.00, which you do not wish to accept. I confirm that we will not refund all the charges you have incurred on your account over the last six yuears. I must also stress that future charges will stand and we reserve the right to close your account if you do not manage it correctly.

 

I know this won't be the response you were hoping for, to comply with legislation, I would like to let you know that if you remain unhappy you can refer your concerns to the Finanicial Ombudsman Service."

 

They go on to quote the FSO contact details and enclose a copy of the leaflet.

 

What I wanted to ask is this is a standard letter and do I just wait until the 18th and see if they contact me again?

 

I have to admit, I'm getting scared I've taken on too much!

Looking through other people's threads this is more or less normal.

 

If you look at how the Halifax have written the letter then it would appear that both you and them have exhausted all avenues and that because you have not reached an agreement then it's "case closed".

 

They give you another way forward which is to contact the Financial Ombudsman. It's almost like giving you one last straw to clutch on to but the bank know fine well that the FO can't force the bank to pay out.

 

There is a semi-veiled threat to close your account too, in case you haven't learned your lesson from the bank.

 

You will find no mention of Court action.

 

Everything is worded and structured to make it seem that the bank have the final word.

 

THEY DON'T!

 

You have threatened them with legal action and the bank can't do anything to stop you. So on the 18th October, log on to MoneyClaim or pop down to the County Court and file that claim. (Technically you could file it now as it could be argued that you have reached the end of your negotiations with the bank but it is better practice to wait.)

 

Keep going as you are and a few days letter you'll probably get another letter from the Halifax. This time settling your claim in full with interest.

I had the exact same letter, the tone of the letter shows that this is there final response in my opinion, and that there is no advantage to waiting any further to go to MCOL or N1.

 

To cover my own back, I also rang through to the number on the letter (it's the wrong dept mind you) and asked to speak to the person who sent it. I couldn't get them, but asked the person who did take the call if they required the remainder of the 14 days to reconsider. She confirmed that the bank considered the complaint at an impasse and did not require any further time. I thanked her and asked her to record these notes on my file and then logged onto MCOL and filed the same day!

Hi Aardvark

 

I feel a lot better now knowing that it's a standard letter.

 

I'll have to wait until the 18th or at least the 17th as I don't get paid my monthly salary until Friday. I might go with the 17th actually with you mentioning that they don't need any extra time to consider my claim.

 

Hopefully if I start my Moneyclaim off on the 17th, should be issued by the 20th? and maybe the money might be back in my account by the end of October? Knowing my luck they will take it all the way to court!!!

You will be fine; The timetable is the most important thing..... 14 days then file on line if you can ( do it before 9am & it will be issued that same day; couple of days to reach Halifax then your off & running !!!)

My court claim was issued on the 4th Oct, Acknowledged on th 5th, yesterday (7th) I received the court letter to say they had indicated they would defend all claim......and also the letter ftor the Halifax saying they would settle in full (without prejudice etc)!!!!!!!

Haven't had time yet to update my own thread, but rest assured that they are still settling for the full amount.

 

Start planning for christmas......:D

Due to file with Moneyclaim tomorrow morning but wanted to ask if I can complete it online today, save it and then submit tomorrow or do you have to complete it and submit it together?

you can do it today and save it online for 28 days or somthing like that !

 

just make sure you dont get to the payment stage as it will complete it but thats last anyway!

Just looked at my claim form online on MCOL and it seems strange to see my name on something claiming money back from the Halifax!! Normally it's them telling me they want money!!

I had a letter in the post the same day saying the money would be in my account within 7 working days. It was paid in within 4 working days so, get that champagne on ice!
