I'm asking for advice on behalf of a friend who has received a PCN in lovely, loony Lambeth. He only has 4 days to deal with this at the discounted rate.

 

I have lots of pics to post but my post count is too low! Aaaarrrggghh!

Pictures only tell part of the story. Better recount what has actually happened and how this has come about, would be even better if your friend joined and told us as doing this via a 3rd party can be difficult.

Hmm. I'll try with words only for now. My friend's written English is poor so it's best if I do it.

 

The pic on the PCN shows his car on Atlantic Road turning to enter Electric Lane.

 

There are stills and video posted on the council web site, showing him passing the sign. According to the sign and the time stamp on the camera, vehicles are not allowed into the pedestrian zone until 2pm, and the current time is 1.35pm.

 

The signage about the pedestrian zone restriction seems to meet the standard. There are signs on both sides of the road.

 

There are no signs on the two streets in the photos to say that Lambeth uses CCTV to enforce moving traffic laws. As far as I know there are no signs about this anywhere in the borough. Nobody is aware that this is going on until they get a PCN.

 

There is no CCTV policy on the council web site, although someone told me there was one in the past. The only info provided on the site is a very sparse guide which says "Penalty Charge Notices (PCN) are issued either on the street by our Civil Enforcement Officers (CEOs) or by CCTV camera. PCNs can be issued for breaking both parking and traffic rules, including for driving in a bus lane." There's also a downloadable spreadsheet file of the CCTV locations.

 

At each end of Atlantic Road there are small repeater signs with a symbol indicating the use of police traffic cameras. (There are no words.)

 

The camera which shot the video is at top of a 30+ feet pole. The camera and pole are matt black.

 

As the offence was committed 25 minutes before it would have been legal, perhaps the synchronisation or maintenance of the clock in the camera is something which could be challenged?

the use of live monitored cctv for motoring offences is allowed as long as it is an approved device. you can check to see if the camera is an "approved device". Council will know the answer but you may have to do a FOI request if they fancy being arsey about it which of course takes a couple of weeks..

You are confusing parking enforcement with moving traffic enforcement, no such approval is required unless the PCN is for a parking contravention.
