Hello

I'm sure anyone reading this knows the drill, I logged on to legalcare 1 lunchtime at work and signed up for the 14 day free trial (foolishly using my real name/contact details). I asked a question and got a bland generic response. I immediately cancelled my paypal payment realising they were a waste of time.

After the 14 days I received an email saying they couldn't take my payment so I had to contact them. I went to log in to the site to cancel the subscription and couldn't - you can only enter if you add payment details.

Since then I've had numerous emails, texts, calls and letters from Daniel Silverman all of which I've ignored. (Initially because I didn't remember that I'd idiotically added my real address).

Today I've had an email threatening court action and adding £85 to the fees. Reading other threads it looks as if I don't have a leg to stand on as it's clear on the website that cancelling paypal isn't adequate.

I don't want to pay them a penny as they seem to be a [problem] outfit and my instinct is to call their bluff. That said I really don't need the stress and not sure whether at this point I should remain silent and work through the court process or call and start negotiations?

Please help!

Here's some reading for you.

http://www.consumeractiongroup.co.uk/forum/showthread.php?413361-Legalcare-or-Aska-Professional-Ltd-file-court-claim&highlight=legalcare

If you do a search for 'legalcare' using the white box at the top right of the forum, you'll find plenty of threads about them.

Thank you HB. I thought I'd read all the threads but hadn't seen that one.

So it looks as if I've got a far weaker case as I've not got any screen shots and I think they've improved communication re cancelling since the commencement of that case.

I guess I'm going to have to bit the bullet and start negotiations. Sadly I have too busy a life to dedicate the time (and stress) to this.

Any idea on how I can get them to negotiate? Particularly not sure where to start as I've ignored all communication to date.

Hi Holly,

Despite not having screenshots, you can still argue on the same basis as those that have them.

Approx when did you join and cancel. This may be relevant because Legalcare seem to have changed the process once when so many folk started complaining here about their modus operandi.

Hi Slick

It was the 21st Feb so I think after they made their changes?

I've spoken to them today and played hardball. Basically said I'm willing to go all the way to court following on researching them and taking legal advice. I've said I'd been advised to make at least one offer and that was why I was calling.

I've offered 2 months payment (£38) which they asked me to put in writing. I've done so but advised them that I'm not obliged to give my reasons as it forms part of my defence.

Thanks again for your help.

Hi Holly,

See how they respond to your written offer.

Do not speak to them beyond this point and keep all comm'ns in writing only.

Thanks, yes I wasn't planning to do anything else verbally.

I've also started a log of how many calls and texts I get subsequent to my request for correspondence to be in writing.

Hi Slick and Honeybee

I just wanted to let you know that I've reached a resolution with DS.

It's the 1st I've heard since my 1 phone call and email offering 2 months subscription (£38). I've had an email today accepting payment. (Although it was phrased as a last attempt at mediation?!)

Thank you very much for your support and advice. £38 was a fairly expensive lesson to learn about protecting my identity online but cheaper than £278!

Holly.

Hi Holly

Well done on persevering with them, assuming you're happy with the outcome and the content of its correspondence I'd put it down to experience and move on.

Are you able to post a copy of its email or its content with any identifying data removed please?

Hi Holly and I'm delighted with this result for you.

Not perfect but a whole lot better and quicker than having to defend a court case from Legalcare.

Also, the settlement they've accepted is pretty low and none of their admin charges, etc.

I think this is an excellent result for you and thread title amended to reflect your win.
