We are in private rented property and have told the landlord to use the deposit as the final months' rent

(she gave us notice having said she was going to sell the house).

 

We have had flooding,

the gas fire is condemned,

one of the chimneys is in a dangerous condition,

mould grows in the house,

the Stanley gas cooker/boiler is antiquated and regularly breaks down.

 

The landlord has threatened to tell everyone in the town what dreadful people we are,

as well as my employer

and to post it on the Landlords Association forum.

 

She has told us that she is going to issue a summons and get a ccj against us

and we will have to meet all of her costs.

 

we have never been late with the rent,

 

all bills are fully paid up and

the house will be left in immaculate condition.

 

Any helpful thoughts would be most appreciated.

Hi

 

Could you please give us some more info:

 

1. When did your tenancy start?

2. How long was your tenancy for?

3. Have you given notice to end tenancy?

4. Has the deposit been protected? (see this link: https://www.gov.uk/tenancy-deposit-protection/overview)

 

Your landlord is responsible for making sure that all Gas Appliances supplied for you to use are maintained in a safe condition. They must arrange for a Gas Safety Registered Engineer to carry out a Gas Safety Check on them every 12 months. Has this been done?

You don't mention any history between you, property & LL, but there must be some?

 

 

Deposits are for T damage at end of tenancy, with onus on LL to justify, not for final month rent, hence T recourse to DPS ADR for protection against unscrupulous LLs. However bad LL has been & how perfect you have been as T to date, withholding rent in lieu of deposit, without prior Notice or reasonable cause puts you in breach of Contract. Witholding final month usually means T does not have sufficient funds for next deposit at start of new T. Your next application for a T may require you to give current LL address, who may be approached for a ref.

I predict LL will 'find' T damage + rent owing well in excess of deposit and may well sue you in SCC and register a CCJ

This would appear on you credit ref for next 6 years and prob impair your ability to find new rented accom, take out credit for new mobile, internet, bank account/loan etc.

Then again I do not know your LL and you may not care.

Bad LLs will survive as long as Ts also do not mind breaking the rules.
