Hi Andy,

I have been sent an Application Notice (with my name spelt wrong), to be dealt with at a Hearing. I went to the last Hearing but the Defendant didn't turn up without notice. She has only filed the N244 since I sent the bailiffs in to enforce the judgement. She has said she was in hospital but has provided no proof.

Just attend the hearing then and voice or submit a Witness Statement in response as to why you object...I personally cant see the court accepting that reason for set a side and very surprised they have allowed a hearing.

If it was a default judgment and they actually were in hospital and have a chance of defending the claim then a set aside is very likely.

 

I assume there will be medical evidence disclosed to prove she was in hospital.
