Hi all,

 

Sorry but another help request.

 

I've read through the forum over the last few days and

 

just as i thought i was getting my head round things i'm back to been one confused bunny.

 

There is just so much to try and take in and

 

i think I've tried to take in more than i can handle and more than i most likely needed to know.

 

So please let me get started and let me say i really do appreciate anyone's help on this matter

 

So on 5th April i received a claim form nor the Northampton (CCBC) County court from the claimant MKDP.

 

Please see attached photo.

 

The sum owed was from a hsbc current account that

 

when i left the forces i forgot to change address as we rarely used the account.

 

My wife tells me that she remembers been a couple of pounds overdrawn (unauthorized overdraft)

and now it seems it has turned into the sum requested.

 

i need to see statements reflecting the amounts been claimed and were they from overdraft fee's etc.

 

I've seen i need to send CPR and CAA is this correct.

 

My wife has acknowledged the claim from the court to get the 28 days.

 

I'm just really confused from reading to much the exact procedure

 

can i send these 2 requests off at the same time.

 

Whats the next steps.

 

It states in some threads to send these requests to the solicitor

 

but i don't have there address just here name on the claim form

Name of the Claimant MKDP LLP

 

Date of issue – 02/04/2014

 

Date of issue XX + 19 days ( 5 day for service + 14 days to acknowledge) = XX + 14 days to submit defence = XX (33 days in total)

 

What is the claim for – The Claimant claims the sum of 763.22 being monies due from the Defendant to HSBC Bank plc under a bank account facility regulated by the |Consumer Credit Act 1974 and assigned to the claimant on 19/07/2013. The Defendants account number was xxxxxx/xxxxxxxx. It was a term of the bank account that any debt balance would be repayable in full on demand. The defendant has failed to make payment as requires by the statutory default notice served by HSBC Banl plc. The Claimant claims the sum of 763.22 and costs. The Claimant has complied, as far as is necessary, with the Pre-Action Conduct Practice Direction

 

What is the value of the claim? 763.22

 

Has the claimant included section 69 interesticon (8%)within the total claim or is it shown separate within the Particulars but not added to the debt? The sum owed is claimed to be 763.22 but bottom right of notice it says amount claimed 763.22 and then court fee's 55 total 818.22

 

Is the claim for a current or credit/loan account or mobile phone account? Current account

 

When did you enter into the original agreement before or after 2007?post 2007

 

Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. Assigned to MKDP LLP Debt purchaser

 

Were you aware the account had been assigned – did you receive a Notice of Assignment? No

 

Did you receive a Default Notice from the original creditor? No

 

Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? No

 

Why did you cease payments:- We moved and didnt change address on account and ceased using it. My partner believes we might of had a unauthorised overdraft of a couple of £ which has then occured fee's

 

Was there a dispute with the original creditor that remains unresolved? No

 

Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt managementicon plan? No

Safer to send them separately ...they go to the Solicitor named on the claim form.
