Thanks for the reply I have just asked this to be confirmed by a Solicitor, their response is once the Police have finished with the driver then the driver is free to move on.

 

 

If the driver pulls out and drives away there is nothing that the EA or the Police can do as the Police matter has been concluded.

 

 

But due to the location of most of these stops then the Police pull the motorist over for a moving traffic violation/questioning/checking and further make them commit an offence of stopping contrary to the highway code and local bylaws and that of the RTA, I believe you must stop when indicated by an officer in uniform but a defence can be that you must only stop in a safe place, clearly a bus stop clearway is not one of them.

 

 

Which brings me back to the original point why do the EA's think they are above the law and make use of the Police check point to conclude a business transaction.

MM it would appear that these Roadside Operations are holed below the waterline then as many appear to be situated in a bus stop. The solicitors opinion should answer the question adequately imho

So supposedly the Police stop you for as the actual real reason is that the the EA ANPR van is sat further down the road & informs the other EA agents which cars etc to stop!!

 

Is this legal at all? As I thought the Police could only stop you if you had committed a traffic offence/no insurance etc etc!!

 

On Parking Mad the Police are stopping only cars that have outstanding parking tickets on them!! Just so the EA can intimidate & lie outrageously to the unsuspecting drivers!!

 

A few cars who were stopped surely came under "tools of trade" or Motability.

 

Yet the EA still persisted with their lies & intimadation!! It's totally wrong!

 

I too got angry & kept shouting at the TV screen as it's disgraceful that the Police are actually not only helping the EA but are making this whole "set up" seem apparently legal!!

 

As for the fees being charged! At least Highway robbers of the past wore masks & held you at gun point to get your money! They didn't deceive & lie their way to filling their pockets as these EA do!!

 

Anyways if I understand this correctly; if you are pulled over by the Police & after speaking to them. You legally can just get back into your vehicle & drive off with no other recriminations whatsoever??

 

I would love to see if this happens in next weeks as I want to see what the EAs would do!!

I don't suffer from insanity, I enjoy every single minute of it!!

as posts prior, the pol can pull someone over for their police checks only, not for the bailiffs (or whoever they are).

so, yes, seems they are acting beyond their powers.

I calmed myself and then watched the latest episode.. My calm did not last long, just the 4 and a half minutes that passed until Debbie said "Certificated bailiffs" conveying irrelevant and so misleading information.

 

It was good to see that Caroline Sheppard will cancel the hearing and find for you on the papers when you have a good case. I wonder how many times she does that. I leave to one side the basic principle of Adminstrative Law of the Right to be heard and why shouldn't I when Caroline also does....

The Constabulary's involvement with regard to the policing of bailiffs as with any other civil dispute - is to prevent a breach of the peace from occurring

 

4. PROCEDURES

 

 

4.4 If the documentation is in order, the constable should remind the bailiff that entry must be obtained without force, except in the circumstances highlighted in

Appendix B. N.B. Bailiffs can take goods from outside the premises such as a debtor's vehicle on a driveway (if they have a clamping order), or garden equipment.

 

4.5 Constables should be aware of their duty to keep the peace. If there is a sufficiently real and imminent threat of a breach of the peace, the constable should be very careful when determining who is acting unlawfully, then act accordingly by arresting the prime culprit of the potential breach, or using his/her discretion to diffuse the situation. It is vital to remain impartial to determine whose conduct is unlawful.

 

4.6 However, it is not the responsibility of the Officer to act as an arbitrator between the bailiff and the debtor, nor to determine the rights and wrongs of the issue, and in no way should the officer assist in the seizure of any goods.

Morning all .

Regarding the program , I will watch it again to make sure because my missus turns it over when I become "over excited " and start swearing profusely . One guy stood his ground and stated that parking tickets were a civil matter and that the old bill gathered around him obviously to intimidate were preventing from driving off . Regardless the old bill in this

program have been duped by the bailiffs and are probably praying that they pull over a car that has a boot full of swag to make the operation and filming worthwhile . Why did the police agree to take part and be filmed anyway ? Was there a few quid in it for them , knowing the Met probably .

Can't remember if this has been done yet. Has anyone submitted a FOI to the MPS, as to whether they have or have ever had a contract to assist Civil enforcement agents, in which the MPS received any payment from the enforcement companies ?

 

I am suspecting that the MPS have a confidential contract in which there is a profit share arrangement. So this would make the MPS keener to assist bailiffs and maybe the reason why so many officers attend. Otherwise how could the MPS justify the allocation of so many officers, at a considerable cost.

I wonder what happened to the disabled man with no legs who the bailiffs were obnoxious to and actually made discriminatory comments under the Equalities Act 2010, regarding affording a "nice car" which is an essential for that person, and indeed the High Rate Mobility Component of DLA is meant to pay for, the skank was trying to insist that they had an easy life on benefits to afford the car when the reverse is true, as he offered to pay, even offered to let then clear out his house, but still the lead bailiff insisted he was a "wilful non payer" His problem now is his face is known and someone will likely have go at that bailiff one night when they see him, we should all complain to the council involved and Whyte & Co to show public disgust about their employees cavalier dreadful attitude. He owed for a PCN, not a criminal fine or a serious offence.

 

Anyway, the suited scowling with arms folded fellow on their website contact page looks more like the stereotypical "accused" up in front of the beak, not a professional EA.

I shout at the TV. I can't watch it again, otherwise I might upset the neighbours !

 

I would not mind so much if the EA's featured were following all the rules and these roadside operations had a full legal basis. I would really hate to live in and around London or other major citiies, as I would get road rage everytime I drove. It is just too busy with confusing roads and not enough parking.
