    • Not really. The signs have to go where they are practical. Every single yellow should have a time plate, and the motorist has to look for it - you can just say you couldn't see it. If it's there, and I assume the CEO took a photo of it, then the driver has neglected his obligation to find out what the restriction is before parking.   The only way you might be able to argue this is if the sign is next to a separate stretch of yellow line - eg, separated from the one he parked on by, say, a road junction or a parking bay. Every individual stretch of line needs its own sign.
    • You haven't told us anything about the vehicle in terms of the make model mileage – price paid et cetera. Also where was it advertised and what the advertisement say? On the basis of what you have told us, you should have no problem asserting rights whether or not you are dealing with a trader or a private seller. However it would be helpful if it was a trader – and you say that it is and that you have evidence. The problem is, whether they trade. Do they have any seizable assets? You obviously dealing with somebody who is going to be very slippery even if you get a court judgement against them. Do you know where they live? Do they and their own property? And I suppose it won't be much of a comfort to you but it may be instructive to others when I say that you have managed to acquire all this evidence – but what a shame you didn't go about this before you parted with your money rather than afterwards.

    • Thank you. What you have suggested about a motor trader had occurred and yes she has been naive about this. They were sufficiently satisfied to purchase the car and they did know about the problem. She had been driving it up until the morning of the sale with no problems and she had told them about the oil leak - it's otherwise in very good condition, has a long MOT and has been serviced regularly. There's also the issue of insurance should she accept return (she transferred insurance to her new car )

We don't get many bad posts on here about Excel maybe this is why

 

 

 

 

I recently found out that a close family member(single parent) has a magistrate court fine now with excel

 

 

the bailiff has been in there home and done a levy the fine has been getting paid every month however depending on what day on the month the pay day lands on payments are sometimes a few days late

 

 

If the payment is going to be late I advised to phone and tell them exactly what day they would be paying (even if its the next day)

 

 

relative is off work with stress and doesn't have this months payment (due last week)

 

 

they phoned them today and explained that they could not make the payment because they were off work with stress they were very polite and helpful and gave them an e- mail address to send a copy of there sick note

 

 

E-mail was sent immediately with an offer of reduced payments until they return to work

anyway me being me decided I would pay this months payment (sleep easer in my bed knowing its paid)

 

 

so phone call No 2 explained been on the phone 10 min ago e-mail sent but Hallowitch want to make this months payment for me

lady on phone goes away comes back yes we have your e-mail Hallowitch doesn't have to make a payment we will be in touch with you (made payment anyway )

 

 

 

 

WELL DONE EXCEL AND THE REST TAKE NOTE THATS THE WAY IT SHOULD BE DONE

Well done to Excel and in fact, only about two hours ago JBW Group also confirmed that enforcement has immediately CEASED regarding a debtor who is 'vulnerable' and the same has happened with Collectica Ltd. Marston Group also agreed a 'stay' on a PCN debt for 10 days awaiting proof of vulnerability.

 

The most important point to consider is that communicating with the enforcement company is VITAL.

We have to remember that we are currently in a 'honeymoon and 'post Panorama period' regarding the new regulations but it is nonetheless welcome to see that there are 'some' companies whose Welfare Dept's are working as they should do.

 

I would emphasis that communicating with the enforcement agent at an early stage is vital in order to avoid a personal EA visit.
