    • Hi, I need advice please, Back in November 2018 we parked at The Southgate McDonald’s/Starbucks car park at Stansted before getting our flight.I parked at Starbucks to walk to McDonald’s. I have received letters over the years and have never acknowledged any of them . I now have a CCJ against me as I didn’t think that it was real so never answered My latest letter from dcbl is a notice of debt recovery unpaid county court judgment of £347.92.I know I should have completed the CCJ.Is there anything that I can do now or should I just pay it.Thank you bingoboy

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

can someone please help

 

on the 25th march I received a enforcement order saying I owed £140 for a parking ticket in the LB Lewisham

 

I have no knowledge of this parking fine so

 

I wrote to task enforcement and LB Lewisham.

 

I received a letter back from task saying the parking ticket was for LB Barnet and not LB Lewisham

and I needed to pay it by 21 November 2013 even thou the letter they wrote back was march 2014

 

I called LB Lewisham who told me to speak to task.

 

i called task who Informed me the systems was down till 8th April and could not check their systems till after this date and to call back then.

 

on the 8th April at 8.30am task enforcement attended my property and

 

informed me I had to pay £420 pound now or they would remove my car.

 

I called task enforcement who said as the bailiff was at my door

 

I would have to deal with the bailiff

 

I said you told me to call back to today about ticket

 

but they said ill have to deal with bailiff.

 

the bailiff gave me no option but to pay or he would remove my car.

 

how can this be right when they told me to different councils parking fine was for and wrong date on letter.

 

what do I do now how do I gat my money back.

Can we start at the beginning.

 

This was a parking PCN issued by Lewisham Council? Is that correct?

 

What paperwork were you sent by them? You mention an "Enforcement Order" - is that the correct name for the document you received? Did you receive anything else?

Your query is not too easy to understand (and this is not helped by the dates etc). Would you mind posting back (and this time break break the question down so that it does not appear as one block of text.

 

Did you receive any of the statutory notices from the Council?

 

If so, did you appeal the ticket?

 

If the answer to both questions is NO, then it is most likely the case that the notices from the council had gone to the WRONG address. Have you moved address? If so, have you updated your records at DVLA?

 

Did you receive a breakdown of fees today from the enforcement agent? If so, would you please list the amounts. What forms did the agents give to you?
