Hi All.

 

 

My wife opened a hsbc account on the 6th may 2004 and on opening her account they offered a credit card (still have and upto date) and a loan, she accepted the loan for £3000 and I am sure there was PPI on the agreement, well back then everything did. I thought I would be a bit sneaky and ask them to give information regarding the opening of the account first, nad a hint regarding the loan. They replied with.

Thank you for your recent Secure e-Message.

 

I notice from our records that account number ?????? was opened on 18Oct2006 and account number ?????? on 06May2004.

 

Please note that we hold information only for 6 years for your accounts. If the loan account is older, we are unable to provide details.

 

Details are preserved only for a period of six years due to data protection act.

My reply was.

 

 

Sorry to bother you again but I need this information because I was missold payment protection on the loan, You state that yor records only go back 6 years, if this is correct then it is impossible for you to give the dates you have given me, how can you give me the EXACT dates when the accounts were opened if you don't have records.

I wish to make a formal complaint that I was miss sold PPI on the grounds i did not know i had a choice wether to accept or not, i was informed i had to have it to protect my payments date loan taken out was 6th May 2004 unfortunatly i do not have anymore details.

You most certainly can claim.

 

Has the loan account been paid off and if so how long ago?

 

If it were me I would getting a SAR off to them to get all of the data they hold on you.

 

There is a template for SAR in the CAG library, the link to which is at the top of every CAG page in green. There is a statutory fee of £10 and they will have 40 days to comply.

 

Make sure you add a line to the SAR to say that it is to include copies of all and any agreement you have had with them.

Thanks for the reply, the loan was actually paid 1 year early in 2006.

 

 

I wasn't to sure regarding the time you had to claim, right i am on it.

OK so if the loan was paid off more than six years ago then they may well have dumped the data.

 

However, what they say and what they do are two different things.

 

If it were me I would still do a SAR as you never know what useful information it might reveal.

 

Don't suppose you have any old paperwork lurking in the loft or cellar do you?

Unfortunately no, we don't have anything, I have racked my brains trying to think of some way of getting some info on it, have the dates but not the agreement number, have the account the loan was given on and tried to get some payment info but they only go back 6 years,

Question... would they supply all transactions on the accounts from opening because any payment made would be there on the statement with a reference number of the loan agreement. If she could prove the payments could they argue the existence of the loan ??

I have got redress on ppi from 1987 on a mortgage and also on bank loan take out in 1992 do go for it.

I would send the SAR to their Registered Office address.

 

Also send it by some trackable method so that you know when they receive it as the clock starts ticking from that point.

I got that address from ICO web site ,sorry if its wrong, but I have used it before and my request was fulfilled.

Right people... Update..

 

 

Was searching around the net (like you do) and clicked on a link to HSBC regarding PPI claims, when I got to the HSBC site it appears that the have actually set-up a division to deal with these claims, here is the link

If you look down the page to the paragraph heading " If you believe you were mis-sold PPI, there is no need to use a claims management company." There is a link to Financial Ombudsman Service website you then get a pop-up window with 2 links, one to the website and one to Proceed to Financial Ombudsman Service questionnaire ( pdf ) fill this in and send it off, simple.

 

 

I have already had a response and they have found my insurance number for the PPI stating they are investigating.

 

 

Just thought this might help others, no need to pay to get you money back.

Sorry for late update but been busy.

 

 

My wife got her ppi back in full in june, no arguing with hsbc or nothing.

 

 

They sent a letter with the offer and asked my wife to sign, 7 days later refund was in the bank.
