Hey all,

 

I've been reading through these forums with interest and I would really appreciate some input on how to prepare a successful defence against parking eye.

 

Keeping it vague, here are the facts so far:

 

Overstayed while shopping in a private car park - retail park

Ignored all correspondence

Received Claim form - Issue date = Mid - late March

Sent off acknowledgement of service - defending in full.

 

If there's any information I can provide that would help then please ask away.

PE are pretty consistent at getting letters out in the correct time frame so it is now down to the basis of claim, the contractual obligations of each party.

Read other posts here and the parking prankster's guide to defending these claims and you will see that it is all down to whether PE have suffered a loss by your breach of contract. The wording of the contractn on all of the signs mean that they must show that their charge is a genuine loss or genuine pre-estimate of loss. In other wise why it has cost them £100 because you shopped longer than their sign says you can.

If you bought any sunstantail purchases I would be asking the shops if they mind paying the charge as they caused you to stay there. Gat a response in writing and use it as mitigation just to embarass PE. The landlord isnt a shopkeeper and these stores hate the parking co's as well as it costs them money and goodwill.
