Hello there I am after a bit of advice if anyone could help please

 

Me and my partner have rented a house for 12 months with a 12 month tenancy which we were told would be extended for as long as we wanted the house the 12 months ended on the 28/03/2014 on the 18/03/2014 we received a txt message from landlord asking when he could look at the house before we moved out at the end of the month. We have wanted to move for a while but were waiting for the right place to come up. We have now found somewhere and hope to move in on the 11/04/2014. But we still haven't had a written notice to quit and are worried he will try to keep our deposit saying we didn't give him notice. He is coming to look at the house tomorrow eve as we need a referance from him is there a letter I could get him to sign to say he is at fault not us

IMO the LLs phone call was an unsubtle way of determining your intentions at end of fixed term. T can vacate without Notice on last day without Notice, else it becomes SPT if T still in occupation. He may have heard you were looking elsewhere.

 

 

Anyway, T is now SPT and it wil be 28 May before any T NTQ can take effect (rent payable til then) and 28 June before any LL s21 allows him to seek Court repossession; assuming a s21 was not served earlier in the T.

 

 

I would forget about LL admitting fault, but negotiate an early surrender for 28 April (day before next T period) and pay rent to 28th Apr. On last day get a Deed of Surrender signed by both LL & T.

Have you given LL any notice to quit? When? If not, what makes you think you can vacate 11 Apr, without deposit repercussions?

He has told us we need to be out by the 18/04/2014 as he and his family are moving back in that day this is his first time renting a house out and by the looks of it not got a clue

If you want to be out by the 11th and he wants you out by the 18th, then hopefully it should not be difficult to mutually agree something acceptable in writing.

 

How confident are you about your 11th moving date?
