Woah. Who said to ignore? That is old advice. You must always contest them. Since you have a court claim ( which, if you keep a level head and follow the procedures properly, you will win), you now need to follow a set of timelines. I'll get an admin to move your post to a new thread slinky.

I read it when I googled parking eye whittlingham hall...

 

.so many people had said just ignore as they are not official & cant enforce payments unlike police can.

 

..and a work colleague told me exactly the same..so I did :(

claim for monies outstanding from the defendant ,

as registered keeper in relation to a parking charge

issued 09/01/2014 for parking on private land in breach of the terms and conditions ( the contract)

 

parkingeye?s automated number palte recognition system,

monitoring whitlingham country car park 2 whitlingham lane ,trowse Norwich

 

captured vehicle ( reg plate ) entering and leaving the car park parking without a valid paid parking ticket.

 

The sinage clearly displayed at the entrance to and throughout the car park,

states this is private land is managed by parking eyeltd and is paid parking site along with t+c`s

by which those who park on site agreed to be bound.

 

in accordance with t and c`s set out in the signage the parking charge became payable.

 

Notice under the protection of freedoms act 2012 has been given under sch4 making the keeper liable.

this claim is in reference to parking charge...then some numbers

 

I agree I didn't get a ticket

but this was in January in evening it was extremely dark

& no street lighting as it was down a country park road.

 

...I never see any lights in the car park or at entrance showing CAR PARKING SIGNAGE due to being pitch black..

 

..also the pictures of my vehicle proves how dark it was as you cant even see the driver just the registration plate..

 

.so didn't realise at any point it was a pay & display..

Well not being able to see the contract offered is a reason to claim that no contract enterd into but I wouldnt rely on it as my sole defence. the biggest downfall for these claims is the parking co cannot show a genuine loss that is anywhere near their claim so for a paid parking they can only effectively claim for the £2 that it would have cost to park there and probably a bit of admin costs to chase up the payment.

You can fire off theacknowledgemnt of service and say that you intend to resist the entire claim, which will force PE to cough up for teh next part, the allocation of the hearing to your local court. Make sure that you go for small claims track when ticking boxes if you are offered a choice of small claims, fast track or multitrack. The costs are limited there for both parties. Do not tick the mediation box, it is not appropriate.

When you have sent this off, write to PE at the address given on the court form (might be their solicitor) and demand sight of the contract between the landlord and PE. The contrcats are normally flawed and PE dont like showing them to the defendants so if they refuse you can hit them with this by writing to the judge when the hearing date is set.

oooohhhh crikey...you may aswell be talking in foreign language completely lost me don't understand my next move or whatto do... im kinda thinkin bout just paying it.i don't really need the worry of this now. got couple things going on and this is just one less wld have to worry about If I paid....

I did call the persons who own the land but didn't get to speak to anyone...will try again Monday

If you pay it, you are funding the harassment and unlawful activities this company performs. You are falling into their trap. They do this because they want to force you into paying it. They know they have no basis for making you pay, so they resort to things like this hoping youll pay up.

forgot to say I went to police station showed them the letters friday...one guy said kinda the same and said depends how brave wether u are willing to sit tight & ride it out...going to try get appointment at CAB too :(

im just thinkin id understand it all soo much more if it was explained to me face to face..thats only reason for cab

im now going to read claim form again...see if can understand what options its giving me... this is not my strong point understanding all their jargon they use

The advisors at cab dont know what to advise in situations like this, they play it safe. i think what you actually need is for the info here to be given to you in plain english. Too many people here advise the same things over and over and become complacent. They dont realise that people like you, who need help, just cant get their heads around all the terms.

Sit tight for now. you should still be within the timeframes, so dont get too eager and send it off without proper advice.
