I wonder if someone could help me.

 

 

I put in a claim for PPI with regards to a credit card I've had for 20 years with LLoydstsb and now Lloyds bank. I filled the form in and sent it off. Someone from, I assume Lloyds, rang me whilst I was at work and bombarded me with questions with regard to my claim.

 

 

I've received a letter yesterday to say that my claim has been rejected for many many reasons including eligibility, suitability, optionality and policy features etc.

 

 

They've included a leaflet for the financial ombudsmen service should I want to appeal the decision.

 

 

I just need some advice really because I want to submit another claim against a car finance policy that I had and I want to make sure that I'm completing the claim form correctly and that won't get rejected also.

What reasons did you give for the mis-sale?

 

Not a good idea to speak to them on the phone as their questions are almost certain to be loaded in order to be able to justify wriggling out of the claim.

 

All is not lost however and you can refer to fos but can you give us your reasons for the mis-sale and some details as to telephone call you had with them.

When I received the phone call, thinking back it must have been from Lloyds. They asked me my name, address etc. They then asked me when I took out the credit card, where I lived, what my employment status was, where I worked. When I gave them all this information they said that they had a copy of the original agreement in front of them and told me where I lived, what my employment status was, where I worked as detailed on the form when I took the credit card. They asked why I thought I had been mis sold PPI so I told them that it was never explained to me and had it been at the time then I would not have agreed to it. I didn't even know what PPI was until it became news. This letter that I received yesterday states that there is no reason why I shouldn't be eligible for PPI given the circumstances at the time of undertaking. I'm not questioning whether I was eligible or not. It also states that I would be suitable for PPI. I'm not questioning whether I was suitable or not. The bottom line is that in my opinion all of that is irrelevant because in my opinion I don't believe I was given the choice.

 

 

Should I write to the FOS with this letter and dispute every point that has been raised by Lloyds with an explanation as to why I don't agree?

You could try a challenge to Lloyds first if you wish.

 

If you were not given a choice then that is mis-selling. It is not up to them to make the decision as to whether you would have taken it etc. etc.

 

Alternatively you can go straight to fos and set out your detailed argument to them.

There is no "magic way" to complete the form that guarantees a complaint is going to be successful. You just need to do it truthfully to the best of your ability. If you have valid cause your complaint should be upheld. If you don't, it (probably) won't.

Forgive me if I have misunderstood you but if PPI was never explained to you then why did you agree to have it at the time?
