Long Shot But Need Advice - PPI Company and HSBC

Hello, it's been a while since I posted but I've been busy with work and recently moving house.

 

In a nutshell he goes...

 

Got a claims company to do PPI for me in 2012

(yes I know, stupid move on my part) and

got a payout from HSBC for £2700.

 

Claims company told me it was for credit card but after doing A SAR in 2013

I realised the majority of the payout was from Graduate loans and only 2 years for the card, May 2007-2009.

I've had the card since 1997.

 

I only realised this as within my SAR was the paperwork sent by the bank to the claims company,

but the claims company only sent me the acceptance letter and not the paperwork the bank had sent them.

 

Now for the long shot bit.

 

I signed the paperwork back in 2012 and got the payout,

but after the SAR I realised only 2 years of the card had been paid and

 

surprise surprise, HSBC are refusing to entertain any of my letters and PPI requests, not surprisingly!

 

The Ombudsman think I don't have a chance of getting the remaining PPI back as I signed the paperwork back in 2012

but as I explained, I didn't have full knowledge of the offer or what the offer consisted of (yes I know, that's on me).

 

Kept all paperwork from both parties and

 

the claims company make no mention in their letter of offer of any other paperwork except for the acceptance form to sign and return, and their bloody invoice!

 

Have I got a case to challenge HSBC due to not being fully aware?

 

Can I challenge the claims company about the paperwork they didn't send me

which would have shown me the dodgy HSBC workings out?

 

Ombudsman has told me to send all paperwork but that it's almost certain they will side with HSBC as it's the claims companies fault

( and possibly mine for not being more aware of what to do before accepting any offer) wish I found this site before going to claims companies!!

 

If I have no chance of challenging HSBC then it's been a very costly mistake,

 

any advice or "I told you so's" welcomed!

can you scan up what HDBC's reply was to you being short-changed

 

 

**you can post up images/letters by this method immediately..you don't need 10 posts**

.

set your default scan page size to A4 less than 300DPI [150 will do]

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

'

BUT......

ENSURE: remove all pers info inc. barcodes etc

but leave all monetary figures and dates.

convert existing PC files to PDF [office has an installable print to PDF option]

it would be better to upload a multipage pdf if

you have many images too rather than many single pdfs

.

or if you have PDF as an installed printer drive use that

or use word and save as pdf

try and logically name your file so people know what it is.

though dont use full bank names or CAG in the title

i'e Default notice DD-mm-yyyy TSB

.

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

...

YOU DONT have to put a link to the attachment in the msg box..just upload it ..job done

Hi dx, it's a basic bog off letter saying I accepted their offer of redress and that they will not be taking any further action on the matter. The letter goes on to say about contacting the ombudsman if I'm not happy but I didn't do the SAR until after the 6 month window and therefore I don't think it will be backed up by them. I did accept an offer from them, but it was without full disclosure, and even on the breakdown the bank provided me, they have only calculated 2 of the 15 years I had the card

You may well find that you only had the PPI for two years. It can be added and removed at any time. Check the statements.

 

If not then you are probably stuffed, it's way over the time frame for normal FOS referral.

The statements provided by HSBC show PPI on every statement from 1997-2012 until I cancelled the card itself, I think I will roll the dice ands end it to the ombudsman and also send a letter the HSBC asking why only 2 years were calculated, as long as I don't ask for money they should answer it!

what exactly did you contract the fleecing CMC to do?

 

were there SPECIFIC account numbers used. and on the refund letter?

 

I don't like the idea of the CMC/HSBC rolling ALL your accounts into ONE CLAIM.

 

they are not

I contacted them and then on the paperwork they sent me filled in the blanks. The thing is, I didnt even remember the Grad Loans until after I received the SAR. I thought the only thing I had was a credit card account. which was the only account number i gave them.

 

The ombudsman also said they shouldn't have rolled them into one claim and should have been dealt with on an individual basis.

I'm thinking of yet another letter to HSBC laying out where they have gone wrong and ask for explanations and also send it to the ombudsman and again stress the points which might help me to get a favourable outcome
