can anyone explain the process for proving irresponsible lending

 

basically I have found myself in a mess

 

I applied for a loan to clear some debt from when I was made redundant - which I did use it for

 

but I also said I would clear my "big" overdraft, same bank same branch

 

anyway they left the O/D there and I used it, and it remained, then I had an accident and couldn't pay, so I pay a token payment 0% interest

 

are Natwest irresponsible for not having cleared the o/d as I had requested at the point of applying for the loan

 

or is it a total long shot?

You do have a complaint in that they didn't follow your instructions to close the overdraft. I don't know what the result of such a complaint would be though as they didn't force you to make use of the overdraft.

 

But with regards to irresponsible lending:

Did you apply for the loan in branch, on the telephone or online?

You said you were made redundant so presumably you weren't working when you applied for the loan? Were Natwest aware of this?

What was your source of income otherwise?

I agree they didn't force me to use it

 

I applied on the telephone, they called me as were concerned with my o/d being so high and in use all the time

 

I wasn't redundant when I applied, I had got in a mess due to having been redundant for 5 months with 2 kids and a house to run with no other income.

 

I was back working when the loan was applied for.
