Amazon trader goods not delivered but signed fraudulently

Hi, ordered fishing equipment through Amazon from a company called Tacklemate, who are uk based on 28/02/14.

 

They state the goods were delivered and signed for but I have not signed or received them.

 

It states on the order that Royal Mail are the delivery company but now Tacklemate state that DX couriers delivered the parcel.

 

I have contacted them and initially they said the signature was my name but now they state it's an illegible squiggle with my surname also printed on it.

 

The further stated that it was subcontracted to another courier in my area and the driver Is going to recheck the delivery address physically.

 

Tacklemate aren't interested although my contract is with them.

If the courier has signed it then he has uttered a false instrument which is criminal offence.

 

Can anyone explain my rights to a refund,

whether I have any chance of small claims success,

and my rights to see signature which I thought I had with data protection laws

How did you pay for the item?

 

I tried courier work many years ago only got paid if you got a delivery /signature

I suspect that is what has happend possibly a miss delivary to wrong address

If i have helped in any way hit my star.

any advice given is based on experience and learnt from this site :-)

Ask for a copy of the signed delivery slip - and confirm the courier they have used.

 

You might also want to raise a dispute with Amazon just so they are aware of what is going on.

Seems to be a regular thing with dx and a few other contract couriers.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

How did you pay? I don't think it's your job to track down what's happened to the goods.

 

If you didn't receive the goods and it's not your signature, then I would concentrate on getting a refund.

Thanks for responding, I paid with a visa debit card, Amazon state as the goods have been signed for they cannot get involved. I have appealed and they won't change tack. The seller states the driver remembers a ' gentleman' signing , which isn't too hard to establish a guess at as it's addressed to a 'MR'. DX helpline customer service state that the driver may have gone to wrong address or forgotten to redeliver. Can I demand a copy of the signature? They state it's illegible but mine is a simple readable one. They state the driver will revisit address to verify and I should contact Monday. It's only £ 23 but I can I'll afford that and someone is pulling one here. It's the couldn't give a toss attitude. I wish I knew how to start a twitter/Facebook campaign

Sounds like he delivered to the wrong address, or he;'s taken the items himself.
