Guys, this is the kind of ideas that I expected from this forum, the legality of FSH, what could mean, being a trader/private and the chances that I can get something out of it or not, this is what I had in mind that I wanted to explore and share.

My plan is still the same, as follow:

1.Sending a letter asking for the repairs cost, I will not ask for the full amount unless the case is taken to court.

2.I will stress that as a consumer I have my rights, whether from a private or trader and that I have been mislead about the car being fully serviced from the main dealer ( it turned out to be a specialist garage) and that there was nothing wrong with it where in fact there are few things that ought to be repaired, I was presented with a recent invoice which suggest that the car was thoroughly examined and fixed with update service , however the seller deliberately concealed some information to sell me the vehicle in which some of the work was not carried out at the recommendation of the garage, some of which the wheel is not the same, serious enough to be highlighted along with other faults. The faults are/can develop into a problem now.

3. Will get Trading standard and Citizen Advise bureau involved if not settlement is reached as it seems the seller is acting as a trader but privately.

4. will get you involved as well on the way to come up with a good case, if I wint some % will go to this forum for the time/effort/assistance that is bringing to so many of us

 

 

In regard to point 2 be careful to confirm the status of the garage that did the work as they don't have to sell the brand of car to be an authorised garage.

It is easier to enter a rich man than for a camel to pass a needle

In regard to point 2 be careful to confirm the status of the garage that did the work as they don't have to sell the brand of car to be an authorized garage.

Sorry I didn't get it, what do you suggest, just to make myself clear, the seller stated on the listing that the car was serviced from the main dealer, however it wasn't and it was just a specialist garage for that particular make.

Can't believe this is still rumbling on...

 

 

I think that no matter the status of the seller, whether trade or private, the faults and advisories are in line with the expected condition of a 9 year old car that had gone round the world more than 3 times.

 

 

No matter who you buy a car from, any secondhand car will have wear and tear on it.

 

 

Personally I'd be staggered if this was ever found to be otherwise by any county court judge.

 

 

I think the OP's expectations were / are far too high. If he wanted a car with no wear and tear or advisory type faults then he should have bought a new car.

Still not enough for a court case I'm afraid, as this should have been perfectly obvious to you when you looked at the paperwork prior to purchase. A minor thing. Especially at 9 years old and 83k, it makes very little material difference to the value, probably 2% or less.

Sorry I thought I had made myself clear but here goes. I'm not suggesting you take any particular action, what I'm trying to do is to save you from making a fool of yourself if you decide to make a claim.

 

Manufacturers appoint main dealers who sell cars they also appoint approved repairs who repair cars. A main dealer may or may not also be an authorised repairer and an authorised repairer may or may not be an authorised dealer.

 

To most people this is a definition that means little or nothing so potentially the statement was used as a accepted short had. People hoover the carpet this is an accepted shorthand for vacuuming but you can do it with a vax.

I still think Salmonella is in cloud cuckoo land with this.

 

It's interesting though that he still persists with minor issues expected of a car of this age and mileage and the spare wheel....well that is pathetic. For a start there is no legal requirement for a spare so the fact there is one can only be a bonus.

AGAIN,

 

What 4X4 is it?

 

Frankly I'd rather hope that the seller if served with court papers they defend on the grounds of a malicious claim as that is what it would be in reality.
