Taking BOS to court in 3 weeks, any advice

Hi.

 

I asked for about £225 from BOS for £12 late payment charges on a credit card from around 2010 back from BOS.

They refused.

I added interest and issued county court papers in December.

They are defending the claim.

We have to exchange court bundles by Monday.

 

I had theirs this morning and have just about finished mine.

A firm called SCM solicitors have been dealing with the matter.

 

What I am wondering is

does anybody think they will deal before court baring in mind it's only 20 days away, will they turn up?

Is it worth calling them and asking for a deal?

They also state they want all their costs back.

I closed the account in 2011 btw.

 

I ask because I'm a very nervous person and dreading court.

I'm not sleeping and wish I hadn't started now.

 

Any thoughts appreciated

I think they would have offered a settlement before now.......tough if they want their costs this will be in the Small Claims Track.

Depends what they throw at it to defend but costs are fixed and restricted in SCT.

We could do with some help from you.

I realise this is worrying you but by offering to settle I wonder if this may be seen as a sign of weakness. When people were claiming bank charges banks were literally settling on the court steps. I was due in court on the Monday morning and having rejected several offers of less than the full amount, got exactly what I wanted the Friday before.

What is in their bundle...what does their defence rely on?

**you can post up images/letters by this method immediately..you don't need 10 posts**

set your default scan page size to A4 less than 300DPI [150 will do]

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

BUT......

ENSURE: remove all pers info inc. barcodes etc

but leave all monetary figures and dates.

goto one of the many free online pdf converter websites ...

put them in a word doc FIRST and convert that to PDF

or http://www.freepdfconvert.com/

or

use www.pdfmerge.com

 

convert existing PC files to PDF [office has an installable print to PDF option]

..

it would be better to upload a multipage pdf if

you have many images too rather than many single pdfs

.

or if you have PDF as an installed printer drive use that

or use word and save as pdf

try and logically name your file so people know what it is.

though dont use full bank names or CAG in the title

i'e Default notice DD-mm-yyyy TSB

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

...

YOU DONT have to put a link to the attachment in the msg box..just upload it ..job done

Could you please keep this thread updated, i am thinking about court for an account of mine for a similar figure and would love to know how you get on. Keep strong and don't let them get away with it.
