Not called for my ESA medical but want to appeal group I am in.

I was due my ESA medical a few days ago - as medicals are on hold for the moment I am assuming they are going to leave me in the WRAG group (I have heard nothing to say otherwise.)

If I had attend the medical and presuming I passed and was left in WRAG I was going to appeal it.

 

So not having had a medical how do I go about that.

Do I get the GL24 form from my JC fill it in with a covering letter and send off.

Will my money still be stopped, even though I am not strictly appealing a recent medical.

How long ago was your last WCA decision?

 

Two weeks short of a year.

 

I did put on my last ESA about my health deteriorating and the tests I am under going.

I did read medicals are still being carried out for people whose health hadsdeclined.

But like I say, I have heard nothing.

Government intention is that Atos complete reassessments already in progress, which I seem to remember yours is.

 

Do you have a letter from Atos confirming that they don't want to see you? Or have they merely cancelled an appointment? If Atos definitely don't want to see you, they're intending to make a recommendation to Jobcentreplus from the ESA50 questionnaire and the medical evidence that's available to them.

 

Should you disagree with the subsequent decision by Jobcentreplus; it'll be appealable, but not via a GL24. The disputes process changed from 28 October 13;

Entitlement to employment n support with the work related activity component is paid pending the outcome of an appeal for the support component.

No I have not received a letter - I was getting ahead of myself as I have not heard anything and usually get a good 4 weeks warning (well my last 2 medicals have been like that) and year is nearly up.

if you not had a ESA50, you can request a reassessment I think,

 

I am confused (not difficult) I did fill out and send my last ESA50 with the update on my illness/s.

They received it checked at the PO site.

 

Before this 2 year hold on medicals I was going to go when they called me, wait to see if I either failed or get left in WRAG and then appeal to be moved into the support group.

 

So will I still get a letter either telling me they are leaving me in WRAG kicking me off ESA or what?

If you've recently filled out an ESA50, then you're on the assessment track and should receive a decision eventually. My understanding is invitation to atos assessment, or decision without atos assessment can take months.

So if I just wait and see what comes in the post then.

I have more medical tests over the next few days, so see what comes of them as well.

I would not mind staying in the WRAG but the WP it is starting to become OTT and I am finding the 50 round trip increasingly stressful and painful.

You wouldn't be able to appeal if it's related to a change in circumstance. You should be able to write a letter (or phone) and explain your change in circumstance. You'd need to meet one of the criteria for the support group. You can't appeal because you don't like the WP.

No I know, I feel I do meet the criteria I asked my GP and he agrees (not that they take that into account) but it gives me strength/courage to pursue it.

yes you have got confused.

 

If you have had an ESA50 then you already reffered, your assessment wont get cancelled.

 

I suggest at some point to ask for a recorded assessment as well, this I think will improve your chance of SG.
