Hi, Sister in law is claiming back £2,500 in bank charges from above bank. Received offer of £700. Sent letter back saying thanks for offer but the amount is for the above charges. Gave them to 15th november 2006. Received letter today saying if she is unhappy to go to the omnibusman. She would like to know how much it would cost to proceed through small claims court? Also should she wait to 15th november or start proceedings now?

This is the reply,

 

Thank you for your letter dated 10th October 2006 received on the 13th October 2006.

 

Thank you for your offer of £656.00 which is unacceptable as my claim is for £2,565.00.

 

I now require repayment in full of this money by the 15th November 2006. Then I shall begin a claim against you for the full amount plus interest plus costs and without further notice.

you should always accept "goodwill gestures" as partial payment. Then pursue the rest, the bank will usually withdraw that offer anyway as they know you're not accepting it as a full and final settlement.

 

It doesn't do you any favours rejecting outright, however short of the total requested.
