    • Hi welcome to the Forum.  If a PCN is sent out late ie after the 12th day of the alleged offence, the charge cannot then be transferred from the driver to the keeper.T he PCN is deemed to have arrived two days after dispatch so in your case, unless you can prove that Nexus sent the PCN several days after they claim you have very little chance of winning that argument. All is not lost since the majority of PCNs sent out are very poorly worded so that yet again the keeper is not liable to pay the charge, only the driver is now liable. If you post up the PCN, front and back we will be able to confirm whether it is compliant or not. Even if it is ok, there are lots of other reasons why it is not necessary to pay those rogues.

Where exactly [carpark name and town] Petrol Station Roadchef Tibshelf South DE55 5T 'operating in accordance with the BPA's Code of Practice' I received a Parking Charge letter to keeper on Monday 15/04/24, the 17th day after the alleged incident. My understanding is that this is outside the window for notifying. The issue date was 08/04/2024 which should have been in good time for it to have arrived within the notice period but in fact it actually arrived at lunchtime on the 15th. Do I have to prove when it arrived  (and if so how can I do that?) or is the onus on them to prove it was delivered in time? All I can find is that delivery is assumed to be on the second working day after issue which would have been Weds 10//04/24 but it was actually delivered 5 days later than that (thank you Royal Mail!). My husband was present when it arrived - is a family member witness considered sufficient proof?
    • lookinforinfo - many thanks for your reply. It would be very interesting to get the letter of discontinuance. The court receptionist said that the county court was in Gloucester 'today' so that makes me think that some days it is in Gloucester and some days its in Cheltenham, it was maybe changed by the courts and i was never informed, who knows if DCBL were or not. My costs were a gallon of petrol and £3.40 for parking. I certainly don't want to end up in court again that's for sure but never say never lol. Its utterly disgusting the way these crooks can legally treat motorists but that's the uk for you. I'm originally from Scotland so it's good that they are not enforceable there but they certainly still try to get money out of you. I have to admit i have lost count of the pcn's i have received in the last 2 yr and 4 months since coming to England for work, most of them stop bothering you on their own eventually, it was just this one that they took it all the way. This is nothing about paying just for what I use - I currently prefer the averaged monthly payment - else i wouldn't be in credit month after month - which I am comfortable with - else I wold simply request a part refund - which I  would have done if they hadn't reduced my monthly dd after the complaint I raised (handled slowly and rather badly) highlighted the errors in their systems (one of which they do seem to have fixed) Are you not aware DD is always potentially variable? ah well, look it up - but my deal is a supposed to average the payments over a year, and i dont expect them to change payments (up or down) without my informed agreement ESPECIALLY when I'm in credit over winter.   You are happy with your smart meter - jolly for you I dont want one, dont have to have one  - so wont   I have a box that tells me my electricity usage - was free donkeys years ago and shows me everything I need to know just like a smart meter but doesnt need a smart meter,  and i can manually set my charges - so as a side effect - would show me if the charges from the supplier were mismatched. Doesn't tell me if the meters actually calibrated correctly - but neither does your smart meter. That all relies on a label and the competence of the testers - and the competence of any remote fiddling with the settings. You seem happy with that - thats fine. I'm not.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

The only thing you need remove from the CPR 31.14 request is the "termination notice".

 

The fact that this is over £10,000 will mean it will be on fast track rather than small claim.

 

Did you receive a letter from B/shark just recently to say they had been misreporting to credit reference agencies ? I ask this question because so many people have received these.

 

Having discussed this with another site team member, it could be implied that the termination notice was sent to you.. because of the assignment.. so you can leave that in :)

B/shark = Barclaycard

 

It proves their record keeping / reporting can be called into question ?

 

Fast track means that CPR is more strictly adhered to.

 

Requests for information when a claim is headed for the small claim are largely ignored by solicitors.

 

One downside to fast track is that costs are involved - these are limited in small claims.

 

Did you ever engage with B/Card when you first had your financial hiccup - ask to make smaller payments with interest frozen ?

 

If you are considering doing this now, you will need to provide an Income & Expenditure form.

 

Do you own your own home - if so, it is likely they will want a charging order placed.

 

I wonder if it would be worth considering a Time Order - see link below.

Yes B card did take smaller payments with frozen interest.

.. I then fell behind and couldn't pay it at £100 a month

eventually ended up here..

 

 

. they sent me begging letters asking me to pay it off at half what I owed!!!

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I'm worried about sending all these requests off if I have no chance of winning, is there any legal guys out there??

 

 

I thought I would have been pointed in the right direction by now as I have not got a lot of time,

i don't want to say i'm defending it when really I have no chance,

I do not want to make a bad situation worse

Unless you do actually send out the requests, then you wont have the information that will enable you to make an informed decision.

 

The date of issue of the claim was 27th February, so your timeline is as follows :

 

Date of issue 27.02.2014 + 5 days for service = 04.03.2014 + 14 days to acknowledge = 18.03.2014 + 14 days to submit defence = 01.04.2014. So you have to make up your mind whether you are going to defend before 18 March

 

From the information you have provided - I dont see that you do have a sound basis for a defence - however, without knowing if the contract was set up correctly or whether you have been denied other statutory rights in the process leading up to this claim we cannot say whether you WILL have a reason.

 

You are concerned about having a CCJ placed on your home.

If your offer of payment is accepted,

then it is almost certain they will want security and apply for a Charging Order.

Apparently forced sales are very rare,

especially where young children are involved

and the defendant makes the payments required by the judgment.

 

If you defend and lose, the fact that the claim is for over £10k and will probably be heard on fast track, will leave you vulnerable to costs.

Thank you, yes that also bothers me about extra costs,

if i ask for the CPR and CCA how many days can they take to send this info?

if they drag their heels I will up against the clock to make my case for defence.

Do I give them a time limit? 3 days 5 days? Thanks for all of your help

 

Also there is no solicitor address listed on the Claim form do i just send back to IDR as stated on the claim form

They WILL drag their feet - even though they are required to respond within 7-14 days.

You can ask for extra time, however you would need to have some inkling that you have a defence.

 

Did you receive a Default Notice from B/card (if it was incorrectly issued, it isnt a complete defence, but helps)

 

Did you receive the notice of assignment when the debt was sold

 

Have you been receiving Notices of Arrears - these are required to be sent out at least once a year (since 2008)

 

When you entered into the agreement - were the terms and conditions and required prescribed terms provided to you at the time you signed the agreement ?

 

At the end of the day, it is you that has to make the decision. It is not one I would want to make given the information you have provided.

 

Whilst you did engage with them originally and enter into a repayment plan

- you were unable to keep to that, did you explain this to them ?

 

 

Do you have other debts have you entered into and kept repayment plans with them?

 

I notice that your wife is also named on the mortgage this will restrict any Charging order application to your share of the equity.

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

...

YOU DONT have to put a link to the attachment in the msg box..just upload it ..job done

Hi Fish

 

Ok first you need to calm down and stop panicking its counter productive and will make you ill.

 

Okay you have sent CPR 31.14 and a section 78 (CCA) request to the claimant now you need to acknowledge the claim.This is done by registering to use the government gateway in order to get your username.Your password is already on the claim form.(keep these safe once done)

 

Acknowledging the claim now or within the 19 days does not commit you to defending or accepting the claim at this stage...its merely an acknowledgment of service.

 

Then we wait.....see if anything transpires from the above requests but keep an eye on your date to submit your plea.

 

In the meantime I want you to look at the links provided re Time Orders and also research Consent Orders/Tomlin Orders.

 

Thats all you can do at this stage so stop stressing.

Thanks Andy I was just double checking as it's didn't seem right,

I wanted to have a back out if needed,

 

 

if no paperwork received from Claimant by next Thursday what do i do then?

as I would need to send my form off by the Friday to make sure it's in by Tuesday 18th
