i have major issue with ebay myself.

 

on the 7th i bought an ipod 160 gb.

 

on there it says seller refurb and hen had put loads of new parts.

 

so i get it and it wont work

 

it says corrupted and error message when plugged in

it wont sycronise my music and keeps saying error message when i try to restore on my pc

wont let me basically useless.

 

and its been in box all this time almost three weeks.

i have tried everything.

 

the seller told me downloaded new i tunes that should work.

spent weeks emailing him but it hasn't worked.

even tried i have and tried it on other computer.

 

problem is seller has been denying it was not working

and saying i wot get refund

 

he got a bit snotty when i opened a case

 

he constantly blames it on my pc

 

but any issue so i know its not problem.

 

its dragged on two weeks and i still haven't had a resolution.

 

then earlier i got email from head office saying i should find someone to fix it

and that made me very angry

 

i spent all that money on it and i am supposed to just fix it

but the way i see it i bought and it doesn't work why should i fix it.

 

if i had wanted to buy one that needed to fix it would have only cost a few pounds.

 

i bought it for it to work and it didn't at all.

 

i have sent long email about sale of good acts and it not being fit for purpose.

and that i should be entitled to a refund repair or replacement.

 

my main issue is i feel i have been lied to

because the seller said stuff in the description

he said it was seller refurb

and lots of new parts and

 

i buy it for that reason and it doesn't work

and i feel like the seller is laughing

he gets my money and i get heap of junk i can't use.

 

i have use ebay for years but i am really upset bout the whole thing

i have to wait 48 hours for their verdict

but if seller had accepted responsibility

and said it was his fault in the first place

it would have been sorted out quicker.

 

any advice can't see this one going my way personally.

I've had an issue with them AND Paypal.

 

I paid a seller for 2 wardrobes in December.

 

He kept promising delivery and still nothing.

 

I tried to get my money back and they tell me I'm past the 45 days (for Paypal to resolve it)

and it's only 30 days now with Ebay

 

I've got onto Natwest as I paid with my debit card

and they're hopeful THEY can refund it.

Not that they should have to.

 

Ebay need to start coming down on rip-off merchants a lot harder than they do.

If you get no joy (though you're well within the timespan) then get onto your card issuer instead.

Good luck. It really isn't good enough.

Hi and welcome to CAG

 

I assume you have used Ebays resolution centre to solve this issue. Do you have a cut off date before you can escalate the problem? If that date has passed, escalate and do not refer to the seller anymore.

It's very important with EBay that you start your complaint as soon as possible, which you have done. Just be patient and see the process through.

 

When you write to EBay, try to break your text into paragraphs, because that makes it much easier to read, and therefore more inclined to listen to you.

 

Unfortunately, the only way to be sure when buying items like this is to go to a real shop, where you get personal service and a proper guarantee in case of any faults!

as you can imagine it has made me mad because they have not listened to what the seller or me has said the seller even forwarded pictures i took of what it was doing on the ipod and i tunes i took loads of pics as the seller requested it. its useless but i cant believe ebay they had the cheek to ask me to get someone to fix it. i had to email and say all the issues and i cannot use . and then a seperate long one about my rights under the sale of goods act stating my rights just to remind them just been a nightmare for me

Unusual for Ebay to say that. I suspect they have got the wrong end of the stick. I think you should contact them again and set the record straight.

but i don't know if i would get me money back as i did get the goods but it is useless and cant use. i will try and find out if i can claim anything back. my mum aages ago bought ipods online and we got a letter from the home office saying they were counterfit and she did eventually get her money back lol. i willl try find out if there is anything i can do through them. its worth trying.'

i emailed telling them all problem with it and all things i have tried and other computers to try fix i but that its n he box it came in in a drawer i cannot get it too work i also said i couldn't fix it myself as i am hopeless sand don't have any friends or family who could fix it. i said i could send it away to some websites online to fix but i could be faced for a bill to get it working more than i paid for it just for 160gb of new hard it would be at least 100 pounds and if it needs more it will work out more expensive than i paid for the ipod and something i cannot afford to pay as well. i do think that as well but it did annoy me at same time seems a bit daft of them

They have definitely got the wrong end. You should state clearly that the item is faulty and the seller is not complying under the sale of goods act. You also wish to return the faulty item at the sellers expense as allowed under the distance selling regulations. You also want a full refund of purchase price and any postage costs you incurred.

just to let you know after me sending email about sale of good act 1979 ebay have taken my side and ill be getting full refund so i feel very relieved because the seller didn't accept refunds i wasn't sure if ebay would give me a refund. two half weeks of stress gone hurrah. got to send it to the seller in nine days.

Excellent! Ebay usually err on the side of the buyer. Just ensure you sent the goods back ASAP so that the seller can't complain.

 

I would also ensure you weigh the package and send it back by trackable means (signed for or special delivery)

 

I have seen where someone has said they got an empty box. Once the money is in your paypal account, move it out (just in case)

 

Make sure you warn other buyers about the conduct of the seller and ensure he doesn't give you negative rep as well.

You will receive a full refund within 24 hours to the PayPal account you used to purchase the item. Should there be any delays, rest assured that you will receive your refund. Expect that you will receive an automatic email from PayPal to notify you that funds have been received. If in case you used a credit card account in paying this item, please understand that there is also a possibility that the refund will be redirected to that account.
