      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

yeah I had a look at that site which I am a member of still.

 

It seems I Cannot reply to the topic on there, they have I guess locked people out of it.

 

I do feel that site has an agenda like they want to try and push the idea that the entire country has huge backlogs and that the vast majority of people will be deferred, this I think is a very bad attitude from them, and number one advice I have always been given is to expect the worst, so them telling people to expect the best goes bang on against that. Especially when its clear many people are not been deferred.

Yes. When I spoke to them back in May/June they said I would get paid as usual. They told me I would probably hear in September about assessment but ive had nothing. Payments still going in as normal. To be honest, DWP weren't exactly helpful on the phone, I was waiting to hear them say about this 2 year deferral but September was the best I got out of them. Im in the South East of Scotland if that helps'

Well that's the theory. I'll reserve judgement about the practice until we see a dent in the 500,000+ claimants currently waiting for an assessment. A figure which doesn't include many routine reassessments.

 

However it's clear that a few routine reassessments are being done. Anyone who's worried that s/he's missed an ESA50 questionnaire or appointment from Atos can phone them on 08002 888777 to check.

The much publicised parting of the ways between Atos and Government over work capability assessments doesn't affect the separate contract Atos have to do assessments for personal independence payments in some parts of Britain.

Got my ESA50 as expected a couple of weeks ago.

 

I still believe this is not a nationwide deferral, just in specific areas with backlogs.

 

Cant say I am happy that its a postcode lottery whether you get a stress free deferral or not.

The original statement about the Deferrals did say that things could change at any time, so it is just a case of accepting that any extra time received has been a bonus of stress free time and try and stay stress free until as and when you receive a new ESA50

Same happened to me in Jan 2014, i rang up and asked how long, i got 2 yrs peace granted. Goodness knows what next Jan will bring. Glad you got some peace.

Still haven't heard about mine. Should have been re-assessed last year. I was awarded P.I.P. until Dec'15 and got my renewal the first week of January, have heard back from Atos to say I might be called in for a medical in around 26 weeks?? That will still be 6 months before my award is due to end. It is looking like ESA and PIP are in a bit of a mess

I didn't get a deferral at my Romford assessment office. ESA50 sent bang on time last April. Hadn't heard a thing. Waited and waited expecting to get a medical assessment again. Called them up as the stress of not knowing what was going on was killing me.

 

Surprised to find they'd made a decision in October 2014 to leave me in support group for 3yrs, no medical this time. May be because I got lucky at last assessment in 2013 as passed their assessment for support group. Would have been nice for them to have told me.

Hi,my reassessment was due the 14th of this month,had'nt heard anything,started to panic incase they sent form out and I didn't get it.

I phoned them and they said they won't be contacting me until dec 2016 to be reassessed for March 2017,so the scans are still running.

I may not get the full 2 years out of it but it cheered me up as I have been stressing about it.

This seems to be the case with a lot of ESA claims, my review date was last year in November, have subsequently found out that it is now November this year. The difference over here in N Ireland is that ATOS are still in charge of assessments as they have a separate contract with the DSD as opposed to the DWP over there, no doubt Maximus will take over after the welfare reforms have been introduced.

does anyone know what's happened about this?

 

 

yesterday [25th Aug] i got another ESA50 form.

 

1yr 1m 3wk 1 day after my medical & only 9m 4wk 3 days since i appealed & was put into the Support Group of ESA.

 

 

 

will i have to go to another medical?
