Hi guys,

I joined Vodafone Friday last week and I have started to experience signal issues. This varies from receiving 'No Service' to trying to use the 3G service which is excruciatingly slow and then stops working altogether after a few minutes of use. Another phone I have which is on the 3 network works fine.

I was wondering if it would be possible to have my contract cancelled as I am still in the cooling off period?

Hopefully I can grab the attention of the VF forum team.

Thanks in advance,

Tom

Hi Tom

Depends where you got the device from.. If direct from Vodafone, you do have a cooling off period which you can start

If you got the phone from CPW or P4U for example then I dont thinl they allow you to return the handset.

If you email Vodafones CS team and Include WRT135 in your subject line for the email, Lee will respond.

Vodafone are one of the good companies on here and can do wonderful things.

We could do with some help from you.

Hm, you'd think I would still be covered by the DSR. I checked out that link and it says returns can only happen if you have not inserted the SIM card which doesn't help me! Hopefully the VF team can still assist.

FTAO the Vodafone team: #6193516 is my email reference number. I included in the subject: WRT135 - CAG

You are covered by DSR. Simple - you notify them of your intent to return the goods and cancel the contract within 7 working days (day 1 is the working day after you received the goods). No point in contacting Vodafone, it's not their equipment they provided you so they will quite rightly have no interest in taking it off your hands. However, they might give you advice, which should be the same as this:

Contact the 3rd party dealers. Advise them that you are returning under your rights under DSR and therefore require a full cancellation of the contract as part of returning the goods. The mention on their website about the phone needing to be unused is in complete contradiction to Distance Selling Regulations. Have a read for yourself on http://dshub.tradingstandards.gov.uk/dsrexplained in the section titled "Your customers’ rights on refunds and returning goods." It's pretty concise as to your rights.

Hope this helps.

Thought i'd just quote the exact wording from the government website which really sums it all up: "DSRs do not link cancellation rights with your ability to resell items as new. Unless the item falls under the cancellation exemption , customers can cancel a contract and return the goods to you even if they have opened and tested the goods and, as a result, you are unable to resell them."

That's great, Jack. I did send MPD an email yesterday I believe but may be worth giving them a ring in the morning. Thanks!

Hi Tom,

Thanks for making me aware of this.

For further help with network related queries I'd recommend following the troubleshooting steps on our eForum here.

In regard to cancelling the agreement, this is something which MPD would need to agree to.

However, I've received your email and so will take a closer look at things and get back to you as soon as I can.

Kind regards,

Lee

Sorry for bumping up the thread with no relevant information but does anyone have a general contact email address for Vodafone?

I know I can contact Lee but it's not a massive problem and he seems quite busy as it is. I tried via my account but the only options are writing, live chat or the eforum. However, writing takes too long, live chat will be difficult as I only have access via my phone which means spelling error central and the eforum won't accept my log in details that I use for my account so I assume I'd need a log in for that.

In short an email address would suit me more :)

Thanks Lee.

Thanks, Lee. Would you agree with what Jack is saying I am within my full rights to cancel it within 7 days? Ringing MPD sometime today.

Hi Tom,

Usually I'd say you would, but having checked MPD's return's policy it appears that some discretion may be required.

How did you get on with them on Tuesday?

Hi Lee,

I'm afraid I can't provide you with an email address.

If you're still in need of help with things, could you email me with your details via the Contact details here and quote the code WRT135 - CAG Forum in the subject line?

Kind regards,

Lee

Hi Lee,

After thinking about it, I just decided to stay with you guys. I can give you details over the phone if you're still getting in touch later?

Thanks,

Tom

Sorry to the bump the thread but just wanted to update you guys.

Exchanged a few emails with MPD and they agreed to cancel the contract when the phone is returned inside the 14 days return period so all worked out.

In terms of getting a PAC code to transfer my number to my new provider, who would I need to talk to about this? Would Lee be able to provide me with one?

Thanks guys,

Tom

Hi Lee,

Thanks, however, I don't currently have a working phone at the moment so it'll have to be via email if you need to get in touch.

Cheers,

Tom
