Firstly make sure he is fully aware of the facts.     • Thank you for your reply, DX! I was not under the impression that paying it off would remove it from my file. My file is already trashed so it would make very little difference to any credit score. I am not certain if I can claim compensation for a damaged credit score though. Or for them reporting incorrect information for over 10 years? The original debt has been reported since 2013 as an EE debt even though they had sold it in 2014. It appears to be a breach of the Data Protection Act 1998 Section 13 and this all should have come to a head when I paid the £69 in September 2022, or so I thought. The £69 was in addition to the original outstanding balance and not sent to a DCA. Even if I had paid the full balance demanded by the DCA back in 2014 then the £69 would still have been outstanding with EE. If it turns out I have no claim then so be it. Sometimes there's not always a claim if there's blame. The CRA's will not give any reason for not removing it. They simply say it is not their information and refer me to EE. More to the point EE had my updated details since 2022 yet failed to contact me. I have been present on the electoral roll since 2012 so was traceable and I think EE have been negligent in reporting an account as in payment arrangement when in fact it had been sold to a DCA. In my mind what should have happened was the account should have been defaulted before it was closed and sold to the DCA who would then have made a new entry on my credit file with the correct details. However, a further £69 of charges were applied AFTER it was sent to the DCA and it was left open on EE systems. The account was then being reported twice. Once with EE as open with a payment arrangement for the £69 balance which has continued since 2013 and once with the DCA who reported it as defaulted in 2014 and it subsequently dropped off and was written off by the DCA, LOWELL in 2021. I am quite happy for EE to place a closed account on my credit file, marked as satisfied. However, it is clear to me that them reporting an open account with payment arrangement when the balance is £0 and the original debt has been written off is incorrect? Am I wrong?

I Know! .... someone here with a chance to sue Highview for breach of GDPR with a very good chance of winning, I was excited reading it especially after all the work put in by site members and thinking he could hammer them for £££'s and then, the OP disappeared half way through. Although you never know the reason so all I can say is I hope the OP is alive and well regardless. I'd relish the chance to do them for that if they breached my GDPR.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Guys.

I see a number of threads on here about the Sofa Specialists of Droitwich and Brimingham.

 

I have won a Small Claims court by default against these people.

 

Their history makes me wonder if I will acually get anything back.

 

It has become obvious that they are using false business addresses and/or avoiding reciept of mail.

 

In readiness for further action I want to compile as much current information as I can about this business and it's owners.

 

Anyone here with present problems please shout back :)

Hi. My Mother and Father ordered a Sofa from a shop in Droitwich called 'The Sofa Specialists' approx 10 weeks ago. They have now tried contacting the store to check their delivery and cannot get hold of anyone. So i decided to do some digging and came across your post. Can you elaborate more on your experience? Do you think my parents will ever get their suite? And if ot who can I contact to take this further?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

We rejected our suite under Sale of Goods Act.

Sofa Specialists Head office given on the paperowrk when we ordered does not exist.

Post sent to the shop in Droitwich is not accepted as they open after the post round time. Registered mail is not collected after being carded.

Emails are ignored.

 

I suspect all the above is selective.

 

We had a visit by Oliver Goode (manager) (owner?) and a rep from the manufacturer to "inspect and report". This wasnever followed up with any information. Court letters where ignored ("we never recieved that").

Judgement was made by default which they ignored.

Enforcment letter was ignored.

The Baillifs are going in now BUT tbh I do not expect to get anything having seen the background to Sofa Specialists.

Royal Mail still have the DROITWICH address registered as Land of Leather LTD (one of their old bankrupted names).

 

I hope you paid by credir card SHamer...............we didn't. We used debit card.

fatdaddy, does your receipt have their company details on it. I have tried looking for the company using the names you have posted and can find nothing.

 

Is there a company number anywhere?

Far as I can tell there isn't a company behind it any more. The card receipt shows "Sofa Specialists" with the Droitwich postcode (DY9 9AY)

 

HSBC tell me there is no circumstance where data protection allows them to disclose who owns the bank account I paid to.

The order/invoice we have from payments made in Sept 2013 and Dec 2013 show

Sofa Specialists No2. Droitwich Park Retail Kidderminster Rd Droitwich Worcestershire.

And Sofa Specialists Warstock Rd Kings Heath Birmingham B14 4RT

Hi, thanks for all the advice.

 

I emailed them yesterday for an update, and they have replied today asking for an invoice number.

 

So I guess all I can do now is sit and wait, and see what turns up.

 

If they do not get back to me I will be going down to the store on Saturday to get some answers.

I've been reading the posts about Droitwich Sofa Specialists, and I've an issue with them as well. Because of what seemed to me a run-around by a man called Oliver (manager?) I'm trying to get back a deposit made, unfortunately, with a debit card. Having asked me to phone him if a cheque hadn't aarrived by a certain date which it hasn't my phone calls have not been returned. I have never had this problem before and am becoming very frustrated.

Was the payment made by "Visa" debit card? If so you make have some protection from that.

No help to you Thespian but I got my HCEO through yesterday and have issued it.

 

Far as I can tell Oliver Goode (ponytail) is the manager/owner and has been involved with all the many past versions of "The sofa Specialists"

I had a phone call from "Oliver" on April 1st (the day after the HCEO was delivered) saying

"we agree the quality of your furniture is bad and would like to collect and refund"

I agreed to cancell the enforcment on the condition that the money was in my bank within 24hrs. Needless to say nothing has turned up ! Just another delaying tactic, although for the life of me I can't see what they hoped to gain ?

 

My only advice to everyone is AVOID AT ALL COSTS

Like yourselves i purchased from this company in December 2013, given i brought the sofa in the sale period i did expect some delay in delivery which is expected. Finally around the time the sofa was ready i received a call from there head office wanting outstanding payment in full. Way i deal in business is i want to see the goods before i pay balance its just me.

Have to say after a couple of calls back and forth they arranged for my sofa to be at Droitwich store for inspection and to make outstanding payment.

Ok it was 3 weeks late but they delivered what they said they would and would i buy from this company again, i would say YES as not everybody has had a bad experience with this company and i would just like to point this out. :-D

I'm sure that may be true but historically Sofa Specialists, in whatever their current guise is, have serious quality issues.

Hi fat daddy ordered 3 seater&2seater leather sofas beginning of January said it would be 14weeks have rang numerous times told would ring back no reply been to shop told would email company suppliers and ring back. No

reply .we paid deposit by debit card so guessing we have lost that any ideas would be grateful .never had to deal with a problem like thus before.only wish had checked them out on Internet before hand

We gave up trying to get meaningful responses from Sofa Specialists and went to court.

 

We did get a contact at each stage of court papers being issued (coincidnce of course !! )

and the day after the Bailif papers were issued

 

we had a call saying they would make full refund.

 

A you can see from other posts some people have a very different experience.

 

Depending on how much deposit you stand to loose you either put it down to experience or make a stand.

 

First thing either way is to send an official registered letter stating what your course of action will be.

Hi there i did some deliverys for this shop we got there early had to unload lorrys full of sofas didn't leave till lunch time every delivery we got to there was a problem with the sofas wouldnt fit worng sofas was mouths late after a few mouths of every delivery dealing with unhappy customsers working till 1-2 in the morning not getting payed full payments i told ponytail man to stick his deliverys this weekend 27th-28th june 2014 drowich shop has closed down thank god
