    • Yes that looks fine. It is to the point. I think somewhere in the that the you might want to point out that your parcel had been delivered but clearly had been opened and resealed and the contents had been stolen

    • Okay please go through the disclosure very carefully. I suggest that you use the technique broadly in line with the advice we give on preparing your court bundle. You want to know what is there – but also very importantly you want to know what is not there. For instance, the email that they said they sent you before responding to the SAR – did you see that? Is there any trace of of the phone call that you made to the woman who didn't know anything about SAR's? On what basis was the £50 sent to you? Was it unilateral or did they offer it and you accepted it on some condition? When did they send you this £50 cheque? Have you banked it? Also, I think that we need to start understanding what you have lost here. Have you lost any money – and if so how much? Send the SAR to your bank as advised above

The defendant contracted Evri to deliver the parcel (Evri Reference xxxxx) and refuses to reimburse the claimant on the grounds that the claimant did not purchase their secondary insurance contract. The defendant seeks to exclude their liability in breach of section 57 Consumer Rights Act. The secondary insurance contract is in breach of section 72. The claimant seeks reimbursement of £265, plus P2G fees of £9.10, plus postage costs for two first class letters to P2G of £2.70, plus court fees, plus interest.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have just become aware of this action group site and am considering sending DPA letter to Halifax for the 3 accounts I have with them. They owe a small fortune for the last 6 years but not sure how likely they are to do the right thing and pay up.

If you really want your money back you will get it although there is a risk that you may have to argue your case in front of a District Judge.

 

The main risk is that the bank may close your accounts and you will need to consider the impact that this will have on you.

 

Have a read of the FAQ section and the Library. This will probably take you a couple of days. Having done that, have a think about it and post any questions here.

Go for it! I have five claims ongoing at the moment 3 with Halifax,1 with Llloyds and 1 Northern Rock. But yesterday halifax paid up on my biggest claim over 4 G, have courage, you can do this, if I can you can, But you must be prepared to go to court if it gets that far. It was a very scary thought for me, I have never taken anything on like this before, I won't even complain at a restaurant, (well I will now).But I was prepared to go to court.

I have just sent my DPA letter to Halifax and i have never done anything lik this before but i have hope! My life has been made a misery because of bak charges so i am determined to do this. Just in the process of opening another bank account as i would be screwed if they closed mine so i would advise you to consider opening one.

Hi, I just got a letter from Barclays yesterday. Basically the content of the letter states that they can't pay any money back to me as they believed that the monies (charges) are justified according to their terms and condition... the 14 days given to them will be up by the 9th April - so what next?

I took my DPA requests into my branch a week ago and was given a receipt for it and was told that the manager would take the appropriate action. I also gave permission for any DPA costs up to a max of £10 could be taken from each account. They are now saying that they have never received the letter despite the fact that I have a signed receipt from them. I am taking the letters in again tomorrow but will be reminding them that they have wasted 7 days of the 40 they are allowed.

 

Also had more charges today for a returned dd to them however for the last 6 payments they have taken the money on the 13th but this month they decided to take in on the 12th. They get you everyway possible.

it may be a good idea to post to the trinity house address and send it recorded delivery, only allow 28 days max for reply, i only gave them 2 weeks on all the letters i have sent to them, my next move is a summons

They have not paid out any moneys in light of the recent hype in the media and are not changing their banking practices in any way. And they have not been taken to court by anyone and lost to date.

 

It did sound rehearsed and in light of this should I now proceed with my claim through court. If you have had a full settlement from the Halifax can you let me know.

If they've had your LBA and the time has elapsed, then take it to the next stage and then you'll find out that they DO pay up. They haven't LOST a case in court - because they haven't BEEN to court!

Have a look at the Litigation Concluded section at the top of the BAG. Strange, I just checked it out and there seem to be quite a few Halifax cases concluded!!!!!

There's been at least three settlements today alone, all reported on this board.

 

It's just scare tactics by them - very pathetic.

 

Stick to your guns, and more importantly, your deadlines. It is they who are in the wrong, not you.

Stuartlin, if you do speak or write to the bank again it might be worth asking why they deliberately lied to you about this. Yet more proof of how untrustworthy they are! :o

We have put in 3 LBA for 3 accounts we have with the Halifax. The first response said that they wouldn't be responding to our letter! and matter was closed. Yesterday we received a letter offering us £50 in full and final settlement against all our accounts - we are claiming just over £1100. I will be writing back not accepting the offer made in this standard letter. I will also be questioning why one letter said the matter was closed only to be followed up by an offer letter. I will give them 7 more days to make the offer in full to us and then I will follow up by court action if they do not comply.

 

Does anyone have any advice if they have been faced with the same scenario.

I am assuming that you have followed the procedures (14 day prelim then 14 day LBA?). If yes then you won't have much else to do but county court after the time is up.

 

If no... I suggest you have a read of the FAQ's below.
