Just checked my balance & recent transactions - over the weekend £1222 cleared into my account, which is 100% of the amount requested and furthermore makes me a very happy bunny!

 

Will be making a donation to the site to thank everyone for their advice and support; then I will be looking back at my old NatWest account which defaulted a few years ago...

Here we go again... After all that palaver I neglected to make sure that the pending charges were cancelled, and (unbelievably) also neglected to check my statements for June and July. Yes, I know...

 

I was charged £125 in June, which caused another £125 in July (plus the DD for my rent was returned, another £30 and they didn't even bother to inform me) and finally £16 at the start of August. Another letter to Phil Beaumont is being composed today, asking for £296.

This is my letter to begin "round two", hope it's the right tone. Any thoughts?

 

Dear Mr Beaumont,

 

ACCOUNT: xxxxxxxx

 

With reference to our correspondence of April and May this year (your refs xxxx and xxxx) regarding charges applied to my account, I am disappointed to find that a further £296-00 in penalties has been charged to me.

 

I would like to remind you that these fees which you have been applying to my account in relation to exceeding overdraft limits and so forth have been judged unlawful at Common Law, Statute and recent Consumer regulations. Furthermore I would again draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law.

 

Bearing this in mind I request full repayment of this £296-00, also if there are any pending charges I require these to be cancelled. I will give you 14 days to reply accepting unconditionally my request in principle and letting me know a date by which I will receive payment.

 

If you do not respond or you do not respond positively within this time period, I shall send you a letter before action giving you a further 14 days in which to reflect. I believe that these targets are more than sufficient for a large company such as yours with dedicated staff and departments.

 

After that will be no further communication from me and I shall issue a claim at the expiry of the second deadline.

Two things today - firstly my letter has been received; secondly i got a lovely letter "from Mark Bowden":

 

I am writing to see if we can be of any help, as your account is overdrawn by £800-58. Your agreed limit is £700.

 

It would help us if you could please pay sufficient money into your account... blah blah blah...

 

They want to help, isn't that nice? They still haven't bothered to get in touch about the DD they returned last month because of their charges though, have they? *barely conceals contempt*

Three weeks after my initial letter, their reply arrives - an offer of the £296 I originally asked for, from one Colin Langdale. Shame I have already sent my LBA, adding their charges in the interim plus whatever they intend to take from me on 2nd October...

As predicted, today I got a letter from Miss N Kelly:

Following a review of your account we have made a commercial decision to withdraw banking facilities... 30 days... blah blah...

 

I now need to do some serious sums regarding the amount I am overdrawn, the amount I will be paid in the meantime, etc. Anyone have any advice? :(

I just noticed that HSBC have returned a payment I made with my debit card - I thought the whole point of a debit card was that if the money wasn't in the account, the card would be refused on the spot..?

OK they have had their 14 days, so I will fill out MCOL today. I have had enough messing about.

 

Bearing in mind their letter stating that my account would be closed on 21/10, I am transferring to A&L Premier Direct. I am also tempted to tell HSBC that I consider their intention to close my account to be directly related to my complaint(s) and that if they go ahead I will consider my debts to them cancelled unless they say otherwise within 10 days. I think that is a reasonable timescale all things considered.

 

Funnily enough I spoke to one of their call centre staff last night who said he could see no record of the pending closure...

Dear Miss Kelly,

 

With reference to your letter dated 21st September (your ref XXXXXXXX), I note your “commercial decision” to close my account on 21st October and confirm that I am making alternative banking arrangements.

 

I consider this decision to be directly related to the complaints I have raised regarding HSBC’s regime of unlawful penalty charges; I would advise you that if you do this I will consider that you no longer require me to repay my loan and credit card, and that you have cleared these debts as compensation.

Yeah well at least it proves they do sometimes read our letters... Alan Pretty says I still have to pay back my loan and credit card :-P

 

Question for the forum: what do I do about extra charges that have been applied since I issued MCOL on 5th October? I've tried not to touch the account but inevitably there was a SO/DD or two that was returned.

I have here an offer from DG Solicitors for the full amount of my claim, including my court fee, with the usual conditions attached. I intend to accept the offer but not their confidentiality clause; I will also make a condition of my own that they refund any charges levied since the date of my MCOL...

On the same day i get a "transfer of proceedings" letter and AQ to fill in, I also get letters from DG and HSBC confirming £737-24 credited to my account.
