    • I can only speak from personal experience. But a similar thing happened to me. Seriously dented door.  I made the other insurance pay. They regarded it as a write off. Took the money, replaced the door. Never heard anything more about it.    Except clearly someone sold my details to claims company, because I got loads of calls in bad English for a few month's 
    • The incident was 03rd March 2024 - and that was the only letter that I have received from MET 15th April 2024 The charge I paid was at the Stansted Airport exit gate (No real relevance now - I thought this charge was for that!!).   Here is the content of email to them (Yes I know I said I was the driver !!!!) as said above -  I thought this charge was for that!! "Stansted Airport" Dear “To whom it may concern” My name is ??  PCN:  ?? Veh Reg: Date of Incident: 03rd March 2024 I have just received a parking charge final reminder letter, dated 10th April 2024 - for an overstay.  This is the first to my knowledge of any overstay. I am aware that I am out of the 28 days, I don’t mean to be rude, this feels like it is a scam My movements on this day in question are, I pulled into what looked like a service station on my way to pick my daughter and family up from Stansted airport. The reason for me pulling into this area was to use a toilet, so I found Starbucks, and when into there, after the above, I then purchased a coffee. After which I then continued with my journey to pick my daughter up. (however after I sent this email I remember that Starbucks was closed so I then I walked over to Macdonalds) There was no signs about parking or any tickets machines to explains about the parking rules. Once at Stansted, I entered and then paid on exit.  So Im not show where I overstayed my welcome.. With gratitude    
    • Just to enlarge on Dave's great rundown of your case under Penalty. In the oft quoted case often seen on PCNs,  viz PE v Beavis while to Judges said there was a case for claiming that £100 was a penalty, this was overruled in this case because PE had a legitimate interest in keeping the car park free for other motorists which outweighed the penalty. Here there is no legitimate interest since the premises were closed. Therefore the charge is a penalty and the case should be thrown out for that reason alone.   The Appeals dept need informing about what and what isn't a valid PCN. Dummies. You should also mention that you were unable to pay by Iphone as there was no internet connection and there was a long  queue to pay on a very busy day . There was no facility for us to pay from the time of our arrival only the time from when we paid at the machine so we felt that was a bit of a scam since we were not parked until we paid. On top of that we had two children to load and unload in the car which should be taken into account since Consideration periods and Grace periods are minimum time. If you weren't the driver and PoFA isn't compliant you are off scot free since only the driver is liable and they are saying it was you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I meant to post here when I sent my first letter to HSBC.. which was last week (7th April).

I've already added up all their penalties for me exceeding my overdraft limit over the past 3 years I've had the account - £1067 to date, with more to come next month I'm certain. It's no wonder I'm constantly overdrawn when they do this!

I intend to write to MBNA and NatWest also. Fingers crossed...

Been working away, so a week after it probably landed on my mat, I opened a letter from HSBC's Phil Beaumont, which is the standard one offering me just under half of what I'm claiming. I'm not happy with them keeping £600-odd obviously, so I intend to pursue the full amount. Which has since had another month's overdraft penalties added, and my first ever returned DD (!)

 

Trying to follow what others have done, am I right in thinking I should refuse the offer and ask for a full refund?

It was a letter similar to that used by Overdrawn, which workeed for her, but for me it didn't. They still refused to pay, so now I am deciding whether I need to send a Letter Before Action, or just go straight to action and issue a court claim.

Yeah, I looked up overdrawn's letter and was about to compose one on the same lines... Then I pondered whether to wait until my statement arrives next week, no doubt with details of fresh penalties to be applied :S

 

I can always come back to those, I guess.

If you intend to take them to the Small Claims Court, you MUST send them a "Letter Before Action". That's how it works. Otherwise they will use the lack of an LBA against you successfully in court.

where can i find a copy of this letter of overdrawns in case i get a similar response, i have just sent off my prelim letter??? Though my charges are only £173 so i hope to goodness they dont start making a fuss about that little amount but i have a feeling they will !!!

Update:

 

Wow, fast (it's all relative) response this time! Yesterday I received a second letter from Phil Beaumont, of course it's 95% the same as the first one.. This time he has doubled his offer to £1012 - which is still short of the sum I requested initially, and further short of the £1222 they have now charged in total.

 

There is one extra sentence in there though: "If we do not receive your signed acceptance within this timescale [10 days], we will take it that you have declined our offer". How does this affect me, with regard to any MoneyClaim action I was due to begin on the 18th? (their 10 days is up on the 15th)

 

I don't want to give up that £210!

It's not the full amount though is it - I would be tempted to reply, I will accept the offer as a partial payment and still chase for the remainder. Not sure where you stand doing this though???

Thank you for your letter dated 5th May 2006, offering a refund comprising £1012 of the penalties charged to my account.

 

I am willing to accept this amount but I do not consider it a full and final settlement, and I intend to pursue the remaining balance of £210-00 as outlined in my letter of 4th May 2006.

In my usual efficient style, I didn't file with MCOL as soon as I got home the other day, and now HSBC have confused me a little (new tactics?!?).

 

My last letter to Phil Beaumont stated "I am willing to accept this amount but I do not consider it a full and final settlement, and I intend to pursue the remaining balance of £210-00 as outlined in my letter of 4th May 2006". I did not sign/return his letter offering me £1012.

 

Now I have a letter from Alan Pretty "Thankyou for your letter dated 10 May requesting a refund of bank charges of £210", going on to offer me the £210.

There is no sign of the £1012 being credited to my account, despite my conditional acceptance of Mr Beaumont's offer.

 

Do I sign and return both letters (separately?) to get my money, or do I just go to MCOL and claim the 8% interest also?

 

Furthermore, there is £125 overdraft charges due to be applied on June 1st - I need to stop this being applied!

Accept their offers in full and final settlement in your own words; and make clear you are not accepting any other conditions. It's your money, they know it, and they'll just pay up. If they've asked for confidentiality, ask for a large sum of money to secure it; confidentiality is a separate commercial issue between you not covered by any previous agreements.

i think it may also be wise to enclose copies of their offer for the 1k along with the latest offer letter.. for their ease of reference (much as peeps dont want to be be nice to them it looks good from your point of view if does end up in court which i am sure it wont by sounds of it) but thats just my humble opinion :oops:

Have written a covering letter accepting this offer of £210, in addition to my previous acceptance of their £1012 (which they have ignored), making £1222 as full and final settlement of this matter. I've also told them that I want the pending charges cancelled.

Sounds good. I have just done basically the same, I also made it a condition that the pending charges were removed. They were and the money was in my account within hours of the letter getting to them!

 

You will have your money in the next couple of days!

Bearing in mind that they should have received my letter today...

 

HSBC called this evening to inform me that i have exceeded my overdraft limit (I know this) and that £125 charges will be applied on June 1st (I know this too!). I haven't even had a letter off them on one of these occasions for over a year, never mind a phonecall (nice how the letters insist "we have tried to contact you" but there was no missed call on my mobile, no message on 1571... I digress). I've had 2 hard days at work and I want to go to bed, otherwise I might have been more chatty/argumentative - instead I told the lass not to worry, since I got my payslip today, and furthermore the charges etc are due to be resolved... :)
