      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Oh yes - sorry, I should have let you know.

 

I've scanned them up and will show them to one of the team with specialist CCA knowledge, if thats ok? I'm off for 2 weeks as of Monday so I'll also have some more time to spend on it from then.

Ok, hi Gary and Els. and all my other friends.

I have started the new post for O/H loan agreements in the debt thread titled. O/H-V-LTSB sorry I am no good at links.

 

after C&P I have summarised the situation as being

 

(A) we have loan statements showing loan paid in full

 

(B) Equifax report showing loans all paid in Full.

 

© No signed consolidation agreement from LTSB has ever been produced by despite a CCA request and LTSB not conforming to it.

 

(D) No defence from LTSB has been provided to O/H.

 

(E) Claim was officially struck out on the 25th June, how they then got it reinstated I don't know.

 

so any ideas on what to do now?????

Hi Gary, yes I replied to it. God I am so relieved about that. the 2 loan agreements were payed off in full with the Consolidation loan that's why they show a nil balance and why they informed equfax that the loans are now settled in full. but as to the consolidation agreement O/H refused to sign it so they don't have an agreement and have not been able to produce one.

So in effect those 2 loan agreements are no longer valid because the have been pid., what should be valid is the consolidation loan but O/H did not want one so would not sign for one!! but for some reason they gave it to him without his permission as he did not want a new 5 yr loan and without an agreement to cover it!!!

Who's been a busy bee today???

 

Hi Gary, I have followed all your instructions via email, all done, copy of everything ready I just need the new defence and it's ready to go. don't know about you but I for one am glad you have 2 weeks off lol!!,

 

Remus, beleive me never in a month of Sundays could I work out the aviator, Darling sent me the instructions once, made no sense at all I am hopeless with a computer if my boys have showed me how to do something once they done it a hundred times, nothing sinks in I'm afraid. I have been trying to send Sue some photos for agers but cannot work out how to do a simple attachment.:D :D

PM, it made total sense, I did not realise just how much profit the banks make out of chargers, what do you think would be the chance of explaining all that to a court and getting interest x 3 warded??? not a chance! it's bad enough trying to get the CI rate which is easy to explain. also did you include the higher interest rate the bank chargers for consolidated loans???.

 

Just a bit of gossip, my son has a stay on his claim at the moment, he has a student O/D for £1,800 and chargers of £600. they are trying to force him in to converting it into a loan and I have warned him against it so he refused anyway when his student loan went in to his account last week LTSB just took the lot to repay the O/D because he would not convert it. how sad is that. they left him without anything and they know what student loans are for ie rent etc. so I had to give my son the equivalent of the SL, I could only do this because I had put some of the chargers I reclaimed away as savings for a rainy day. the Bank is now getting it all back slowly but surly. it makes you think. I should have blown it all on a holiday that way they would never have gotten any off it back, scumbags :D I know what I am going to do with the next lot of chargers I claim and thats spend it all quick, gone are my loverly new windows I wanted to buy.

Hi everyone,

sorry i have not been around for a while, I have been on holiday but also not too well either but now I am fine again, thank goodness, Just caught up with all the PMs members have sent sorry I have not replied but I will now. thanks everyone.

 

Update on whats been happening, O/H had his directions hearing last Wednesday re his loan and no agreement. As I was unwell I was unable to go with him so big mistake as he is not into all this CAG business so I had to give him a intense lesson in one hour not very clever hmmm

 

anyway he attended court and was awere of the basic principle that if Loyd's could not produce an agreement for a consolidated loan then the loan was not binding

 

When he arrived at the court LTSBs solicitor wanted to speak to him alone which O/H agreed to. he said the lawyer asked him if he wanted to set up a payment plan there and then as if he goes into court it will turn out to be very costly for him, O/H refused but said he became really worried he realised that the solicitor was trying to put the frighteners on him.

 

 

 

The upshot was that the solicitor could not produce they agreement but stated an error had been made by the finance department and he could prove that O/H still owed the money he then appealed to the judge for more time to get the paper work in order which the judge agreed to stating everyone is allowed another chance if they have come to court without the right paperwork err what happened in that chargers case when the claimant did not have the T&Cs I'm sure the judge dismissed that case???

 

What happens now is that LTSB have been given extra time again to come up with the agreement or Prof that O/H owes the money a directions hearing has been set for December with a Final hearing set for January. LTSB must have nine lives or something.

 

Peter I have not received that email from you as yet, Gary I had sent you one but not had a reply are you OK not heard from you in a while in fact I have not heard from many of you in a while so come on everyone get your little fingers moving over the key board and let me know whats been happening to you all lol.

Hi Gary, we received the Order and a amended particulars of claim from the courts and Lloyd's today. One section of the POCs is a bit concerning as they are now claiming that: I have listed some of the main points!!

 

By an arrangment made between the claimant and the defendant on or around novemebr 2003 the claimant agreeed to acept lower monthly payments of £75.00.

 

a) As a result of the defendants (OH) continuing breach the loans the Claimant terminated and closed both of the first and second accounts by.

(i) Making an internal administrative credit to the accounts

(ii) Excising the claimants rights to set off by applying £4.11 standing to the credit of the defendant in to the current account to the debt outstanding under the agreement

(ii) referring the amounts owing to the claimants debt recovery unit as a single consolidate amount in order that they may recover the outstanding balance.

SUBSEQUENTLY EVENTS.

From January to June the claimants agents unsuccessfully attempted to collect the amount outstanding from the defendant

On the 14th July the solicitors for the claimant agreed in a telephone conversation with the defendant to permit the defendant to make payments of the debt in installments of £50 the defendant did not give vllable consideration for this arrangement

The installment arrangement was as a result of clause 5a of the agreement and at law without prejudice to the claimant's right to recover the full amount outstanding if the defendant made to make regular repayments

Further or alternatively it was a expression alternately implied term of the installment agreement that the defendant failed to make repayments pursuant to that agreement the claimant would be entitled to enforce the outstanding balance in full.

Pursuant to the installment agreement the defendant on the 1st Aug 2006 paid the sum of 50 and on the 11 Oct 2006 paid the sum of £100

By entering into the installments agreement and by making payments the defended acknowledge that he was in debited to the claimants.

OK first of all O/H made agreed payments of £75 for an agreed period of 6 months. which he did. After that period the Claimant LTSB wanted to put both loans into one consolidated loan, O/H refused LTSB refused to except any more payments.

 

He cannot remember any phone call from LTSB

 

The only time he risilised that the loan was in fact closed was when we applied for our data info which was infact 2007 and from an exquifax report. He recived nothing from lloyds to that effect and the heading on one of the sheets I sent your clear states consolidated loan.

 

 

we are not sure where these £50 Payments have come from, I need to check his bank statement to see how they were paid and who to.

 

We now have a print out covering all main effects ofver the life of the account which have been logged against O/Hs account and none relate to what the solicitor is staing above. Surley these would be key effents and would have to be logged on them.

 

There is a lot more info in the POC which I will have to copy and send you but I do not have your new address would you mind emailing it to me so I can send you them?? Hmmm bit of a bummer this one.

 

I can see what they are saying about aknoleding a new debt but!!

 

O/H did not know a new debt was in excisitence, as he have never been informed of this.

 

He did not agreed to this new debt, surley LTSB would have writern and told him outlinning what they had done and if so they must have copies of the letters none of these letters have been produced in court all their relying on is a telephone conversation they are claiming to have made made.

 

nowhere in the T/Cs dose it say LTSB will pay our loan in full if we don't!!!.
