    • then the who thing cannot have anything to do with paypal then, they cant be involved at all. chargeback fee? from whom never heard of that one either. ebay/paypal must have changed their T&C's again then since the demise of brexit and EU agreements. i can only assume he paid paypal, who acted solely a payment intermediary, to buy your trainers from ebay. and ebay added a £14 processing fee? thats unlawful hence their refund. i dont think there is anything you can do here sadly. classic ebay scam that goes back +30yrs. just now rejigged for the 22nd century.  typically it only resulted in an unenforceable paypal balance that you simply walked away from... but now ebay has obviously tightened up on losing out to these scammers and added an unlawful fee to scrap some of their historic losses back.

    • please refrain from posting blocks of text...use sentences and line spacing .... i notice your 1st post had been spaced and ive done your last three.... this is not facebook....its a forum. ........... it does not matter how long BS takes i would cease payments now and a DCA is NOT A BAILIFF. they don't own your debts so can do NOTHING!! slow down and calm down , 4 post in 5 mins is no good. Debt management and Debt self-help - Consumer Action Group click the above link and go read a good 20+ thread in the above forum and all your questions will be answered  if you have any outstanding  then please post with them later. everything is explain in numerous thread already here for you to understand at your own pace. there is not rush to do anything today or the next 10days bar simply stop paying. though as explained in my last post, whichever way you go not pay will equal a default which will trash your credit file for 6yrs so the quicker you stop the quicker they will vanish . dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Can't get rid of these muppets despite paying One calls admin fee after they cancelled within 14 days. I don't have a scanner so I will type it out best I can.

And yes the spelling and grammar was that bad. Anyone reckon they are taking court action or is it a bluff? They are a real Mickey Mouse firm who have threads all over the net about their canceling of polices and ridiculous admin fees. Like I said i paid it but it seems £49 was not enough.

 

 

Any advice? They seem to be trying to pose as a court or official agency, I might send it to the OFT.

This DCA is just the accounts department of One Call. The won't do anything, but they may sell the debt on at some point.

 

You should register a formal complaint in writing to One Call stating your case and continue the complaint until resolved.

I have lodged loads of complaints, it seems Judgement Order Listings only exists when they are taking money. They cannot be contacted even if you try.

 

I am not really bothered if they sell it on as I have a failed business and my credit rating is abysmal any way. Just fed up with them, they are an abomination as an insurance company. You take a policy then you get some company called Creative trying to get you to sign loan agreements.

Have you reported them to the OFT & Trading Standards?

 

I think I should, they are clearly trying to pose as Her Majesty's Courts with all the references to court action. Whats the court action number all about?

Lodge a very strong formal complaint to Onecall which is who this JOL outfit really is, and you MUST MUST MUST report them to the OFT&TS also to the FCA http://www.fca.org.uk/consumers/how-to-complain

The latest letter is they are threatening to send a collection agent to my home or WORK!!!

 

This isn't legal surely, anyone help me draft a letter?

 

Is there anyone they can be reported to?

Well yes, as they are attached to an Insurance company, you can complain to the FOS. The FCA are the regulator, but they don't deal with individual complaints.

 

It is against the OFT rules on communication methods. They are not allowed to visit you if you have asked for communications in writing only and they can't go to a work place, as it against OFT rules i.e they can't use methods which are designed to embarass.

 

This is a letter you could send.

Can't believe this out fit.

 

 

They really have no idea what they are doing.

 

 

I took out a policy 2 years ago and canceled within the 14 days

as they wanted paper copies of are driving licences.

 

 

I could supply mine but my partners was at the DVLA as she had just moved.

 

 

It is the first time ever I have been asked for a licence

and it was over the xmas period which slowed down the process with the DVLA significantly.

 

 

They wanted them in 7 days flat which we couldn't do.

 

 

They said I had no choice but to cancel so I did and paid the £49.95 admin fee.

 

They then said they wanted a further £201.21 as the cancellation wasn't processed.

 

 

I argue this as they took the cancellation admin fee off me.

 

 

They are behaving like some kind of bad loan shark.

 

 

They seem to have loads of arms like Creation credit, judgement order listings etc.

 

 

I wanted an insurance policy not a loan.

Like you say they are just acting like petulant little children, IMO make all the complaints you can about them to the FCA who have now taken over the role of the OFT who are no more, and ignore these fools.

 

Playing letter tennis with them is clearly going nowhere, as will any puerile legal action they attempt to bring against you.

I think that their name and also their Ltd company name are potentially very misleading. I'd like to see their letterhead to see how they present themselves. Could you scan a copy to us at our admin email address.

 

I think that you should send a copy of the letter to Trading Standards and also to the Ministry of Justice and ask them whether they think that the letters and the get-up would be confusing to ordinary members of the public.

I think the name was reported a number of times to the OFT in the last couple of years as a misleading business practice. I don't know if any action was proposed or taken.

A report/complaint to the FCA would be the way to go now as it will have all the OFT complaints data.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

Now if you call the number given it is just a payment line and no other options. You cannot email them, if you write they don't respond. I have tried to contact them through One Call but they deny they are an in house company. I have written to One call numerous times, all ignored.

 

Then you have this Creation firm which is equally elusive. Same address again but no response or contact email/number. I was never made aware I was taking a loan off creation in full from day one to pay my insurance. This seems to be were all the charges are amounting.

 

The amount they have asked for and what I paid to date is more than the original policy. In effect it costs me more to cancel in the 14 days cooling off than to keep the policy.

Maybe she went to night school to learn English after it was all over the net how pathetic her spelling and grammar was, lol

 

Maybe she should do a financial/law course next?

 

I have made a complaint to the FSO with the letters attached threatening visits to my employer. Not that it really worries me as I am self employed and they are welcome to visit my boss, it is me.

 

Shows how good their records are.

Yeah well I know that John Radford of One Call has just bagged himself a a very young, pretty wife who looks like she could be quite high Maintenance.

 

I certainly am not contributing towards her upkeep with money I don't owe.
