    • Ok, sure! The company is Community Fibre. The issue is that while my internet speed from tests is extremely fast, I still experience delays in loading websites, connection issues on conference video calls, etc. I called & spoke to an agent, who had extremely poor communication skills and kept misunderstanding the problem & going round in circles. After half an hour of this, I asked if I could speak with a manager, but was told none was available. He eventually promised one would call me back within 24-48 hours, but no call came. I have now written to them explaining everything,  I am waiting for a response (I have an acknowledgment of the complaint). The 'manager will call you back' is a broken promise I've experienced a few times from different call centres/companies over the years, which is why I was curious how others have dealt with that & if there's a good general approach to this. Virgin Media (whom I was with in the past, and had a number of issues) were notorious for a whole range of awful examples of customer service, and this was their favourite it seems!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Credit crunch clearance sale, everything must go. It states ex catalogue stock Argos and Freemans of London. £2 Admission fee. It further states, All goods carry a full guarantee. Does not say who is doing this, not even a phone number. Being held in a pub function room. Dodgy ?

I have been to one of these. Very dodgy. Once in the 'auctioneers' garner support by showing goods at a cheap price then get a show of hands who are interested and if not enough, they clear the room and let the next bunch in and some of the original crowd.

 

What it boils down to is they 'sell' worthless stuff or very cheap stuff at above proper prices with no refunds. If you go, watch out for the 'ringers' and the tough guys who will give grief to the ones that try to get their money back.

 

Having said all that, this may be one of the legit ones.

 

Does the flyer have any company details? Company register number? If not then be suspicious.

If you are asked to deal with any matter via private message, PLEASE report it.

The no admittance 10 minutes after doors open is the big clue - means sales pitch with 'ringers', hyping up the crowd to buy, no opportunity to examine the goods you're purchasing, and you get out with your item to find the expensive stereo system you purchased at 'rock bottom prices' is actually a little plastic radio - happened to my brother at one of these pop up shops on Oxford Street.

Someone rents out a function room, the pub might not be aware of the full effect of what's going on until afterwards when people come in to complain, and by then......

I hear what you say, so in that situation, would nor the pub be legally responsible for any loss..

No, your contract of sale is with the people hiring the function room/pub room not the pub owners.

I got exactly the same flyer through my door this evening at 7pm. I must say it is very tempting but when something is too good to be true it usually is. I did a search online and found really bad reviews about it but I cant attach the link here as this is my first post and you have to have posted 10 times before to attach a link.

 

It has to be illegal what they are doing. Definitely one to keep away from.
