Just to make clear, you MUST acknowledge the claim within the 14 +5 days and THEN you have the further 14 days to file a defence.

I have acknowledged the claim

 

my worry is what to say on my defence

 

as am asking any of you to help me with that

 

so I can have a solid defence to win this

 

as am not going to pay for something that I don't have.

ok firstly we need to await the CCA return

 

as yet its diff to work out

if this is an HP agreement

a credit card

or

a personal loan.

 

typically when buying stuff from curry's it was a personal loan

you also mentioned by now pay later

so it cant be a card

 

but you say the claimant is satans cards uk?

 

you could also send off a CPR 31:14 to get a copy of the documents they are going to rely on

 

the fact the laptop went faulty etc etc should also play a part in your defence

 

IF its mentioned on the agreement that comes.

I have received the credit agreement today and

 

its a loan between me and Santander and comet as credit intermediary,

 

its for purchase of electrical goods.

 

The balance is 553.21 on the letter and

 

the county claim form is 526.30

 

am a bit confused about the amount they are asking from me.

 

I need help with my defence as now its crunch time

 

as it seems they don't know how much I have to pay,

 

any help will be appreciated

can you scan it up please

 

**you can post up images/letters by this method immediately..you don't need 10 posts**

.

set your default scan page size to A4 less than 300DPI [150 will do]

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

BUT......

ENSURE: remove all pers info inc. barcodes etc

but leave all monetary figures and dates.

goto one of the many free online pdf converter websites ...

put them in a word doc FIRST and convert that to PDF

or

use www.pdfmerge.com

 

convert existing PC files to PDF [office has an installable print to PDF option]

..

it would be better to upload a multipage pdf if

you have many images too rather than many single pdfs

.

or if you have PDF as an installed printer drive use that

or use word and save as pdf

try and logically name your file so people know what it is.

though dont use full bank names or CAG in the title

i'e Default notice DD-mm-yyyy TSB

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

...

YOU DONT have to put a link to the attachment in the msg box..just upload it ..job done

I got those of MCOL, I really need help now that my days are almost done before I submit my defence....LEGAL TEAM help me please.

its obv that the agreement is for the laptop that went wrong

 

however have you some way of proving this

 

as nastily comet have just called it 'electrical goods'

I don't have anything but if it says electrical goods I can say its a laptop as that's what I got from comet and all the conversations that I had with Santander they all know its a laptop so I don't think they can deny that.

Summary of the situation.

 

You purchased a Laptop from Comet with Finance from Santander. You had to return the lap top for repair - shortly after, Comet went into administration.

 

Santander, presumably dont want to know !! and the claim has now been issued.

ok you have until the 2nd of march to file your defence

 

I have been doing a bit of reading around

 

and I cant actually find any proof

that you NEED to naildown the comet agreement to the actual laptop.

 

so sorry for indicating that.

 

plenty of time now for our experts here to do their stuff

 

sit tight and you'll be admirably dealt with nearer your deadline.

 

as far as I've found, the fact that the product failed etc etc cannot be ignored.

 

to help those that will assist in the defence

 

if you have any written stuff regarding the repair/sending it/off

etc

 

or if you wish to pop up a BRIEF bullet pointed timeline

of what happened please do so.

yes citizenb and dx am looking for the repair or any letter in regards to the laptop.

-bought laptop

-took laptop for repair

-went to the shop for progress was told they are waiting for the repair team.

-comet went bust

-went to the shop was told shop is under admin there is nothing they can do.

 

-santander started calling and sending letters, called them and explained what has happen santander not interested gave me number to contact admin.

--Contacted admin and he said they will start dealing with issues this yr but will start with big debts before small ones

I cant find any letters all been shredded waiting for your help guys with the defence I know Dx mentioned that I will be helped when my time nears but am worried sick I don't know what to do.
