I have an interesting issue with NCP at the moment and a PCN issued for a car park run on behalf of the train company Greater Anglia.

 

I use this car park from time to time and pay using the Ringo App on my iPhone,

 

have used it for several years and had no problem until now.

 

I recently used it to pay,

all fine,

but what I didn't notice is that the App issued the ticket to a car I no longer owned

even though the day before it issued a ticket correctly to my current car.

 

The old car was deleted from my account but for some reason it has re-appeared.

It isn't very clear when the electronic confirmation appears to verify you have paid which vehicle it is for so easy to miss.

 

subsequently I have received a penalty notice for parking with out payment even though technically i have paid NCP.

 

I am arguing that this is an administrative error and that there is intention to pay,

and payment has been recieved. NCP are rejecting that claim.

Any ideas anybody???

Ask them for a popla code. Then tell popla. back it up with proof of payment and NCP are out of luck.

Popla is the appeals body. When they reject your reason ( all ppc's reject it. Otherwise theyd make no money), they should send a popla code with the rejection letter. You then appeal to popla using specific reasoning.

You made first appeal, they rejected it. They have to issue a POPLA no. to you.

This is an "independant appeal process, which will uphold your appeal because you have paid. This will cost NCP £29-50. RESULT

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

On their letter of rejection to you they should have told you of your right to appeal their decision to POPLA and provided a reference code. If they fail to do so they are limited by law in trying to collect any supposed debt from the driver, not the keeper of the vehicle. If thye havent given you this ref code then you amy make a complaint to the governing body, the BPA and to POPLA for their failure to adhere to the regulations they are bound by.
