hi guys i am coming upto that dreaded time of esa renewal in may2014 and was wondering how it goes as we went to tribunal our first time having gone from 0 points to 15 at tribunal so was wondering how it went now also my husbands symptons have got worse and we think he should be in support group and not wrag xx

you will be sent an ESA50 questionnaire to fill usually about 4 weeks before his renewal date once you send this off it will go to ATOS he maybe be called to attend a medical it has been known that you can be placed in either the WRAG or the SG without a medical but there is always a chance he will be called for one

 

make sure you put as much information on the form and also send in any medical evidence you have to support his reassessment. if he goes for a medical and they score him 0 points again then you will have to and ask for a mandatory reconsideration of the decision i think there is now no time limit of how long this can take though at the moment im sure someone will come along and confirm this for you.

 

if the decision is still a no then you can appeal to the tribunals service as you have done before

A claimant only needs to satisfy one of the descriptors for the support component, but you need to give as much detail as possible along the lines of cos of X (his conditions), can't do Y. With examples of how he copes day to day. Praps he needs a lift to the doctor's cos he can't walk/wheel to the nearest bus stop, or you have to chivvy him to get showered and dressed each morning. Substantial risk to his own health or someone else's? He'll need documentary evidence from his doctor or a similar professional.

:Appeals for Employment n Support Allowance:

The disputes process has changed for decisions made on or after 28 October 13. There's now two stages;

A mandatory reconsideration of the decision by a (hopefully) more senior Jobcentreplus decision maker. Government have declined to set a time limit for reconsideration. Esther McVey (current Minister of State for Employment) claims two weeks. Jobcentreplus have a rather more realistic target of up to fifty working days, one excuse being that they have to allow a month for additional evidence.

If/when the reconsideration is negative, the claimant has the option of a direct appeal to the Tribunals Service.

hi everyone

when you are sending in your esa renawal, sent in all the relevent documents over the last to renewals and there is no improvement in your condition, do you keep sending copys of the same documents, what do you do? its the same condition with no improvement and are you then just rewording it, any thoughts on this would be appreciated

Up to date info is better, but I suppose what you could do is use one of the old letters and perhaps ask your doctor to write a short cover note saying something like "There has been no change in Ms X's condition since the letter I wrote on , which is attached for your reference."
